Marsh (grocery) chain details funds use by ex-CEO

Marsh Supermarkets today detailed what it called “astonishing” information about improper use of company funds by former company chairman and president Don Marsh.

The charges come in a 62-page brief that the supermarket chain, owned by Sun Capital of Florida, filed today in federal court in Indianapolis as part of its lawsuit against the company’s president from 1990 to 2006, when he was fired by new owners. The supermarket chain is suing Marsh for fraud and breach of contract over expenses it says were wrongfully paid out to Marsh.

The brief says that Don Marsh rang up “hundreds of expenses that the company has now determined were largely or entirely for the benefit of Don or other Marsh family members.”

Today’s filing is the most detailed accounting yet of the expenses rung up by Marsh, who was well-known in Central Indiana as the former family-owned regional grocery chain’s namesake president, appearing frequently in its TV commercials and at community events the chain sponsored.
