Save a pod of endangered California Right whales OR Save the life of a death row inmate?

Pod has 22 whales, 7 of which are calves. Death row inmate has 1 month before he's executed, some how you find yourself in a situation where you must choose between the two, save one or the other. So, CHOOSE!

edit: Death row inmate will die in month regardless of your choice to save him now or not. Your action now will not stop him from dying in a month. Oh and he's in California too.
