DeLay, who posted a $10,000 bond and was released near midday, evaded the press corps that had gathered at a courthouse in his home district outside Houston where he was expected to appear.
He is scheduled to make his first appearance in court on Friday in Austin.
DeGuerin accused Travis County prosecutor Ronnie Earle of engaging in vindictive politics and trying to smear DeLay by having the arrest warrant issued on Wednesday.
