Bush knowingly nominated a person he knew wouldn't pass.
And got the person he actually wanted

Myers/Alito.

W wasn't stupid but it suited him to have people think so.

Alito is probably the worst of all 9. And it was nominating Myers that allowed Alito.

Had he nominated Alito first, Alito would not have passed.

remember that lesson

By the time he needs to nominate a new SCOTUS they won't be able to obstruct and he should easily get 3 choices before his second term is over (four if the 4th retires knowing Hillary will win.)

And he already in an even worse climate, got 2 of the best choices in recent times through
(Sotomayer and Kagen).

The tea party is getting less and less popular, so they are more and more margionalized.

If I were President Obama, I would nominate Eric Holder to the court and see what happens.
Then find someone just as good and much younger if they say no.

Or maybe just go straight ahead and nominate Michelle.
Let them try and say no to her.
