(5,170 posts)Try taking a law course and then talk to me about how you don't think the burden should be on a defendant to prove an "affirmative defense." THAT IS WHAT THE LAW IS. Sorry if you don't like it. I also didn't say all homicides were murders. There's also, for example, manslaughter, negligent homicide, and justifiable homicide--all homicides. Sorry, but the perpetrator has to prove the "justifiable" in justifiable homicide because the law does presume that taking the life of another person is a crime. I don't know what country you want to live in, but I think god I live in one where we presume that it is against the law to take someone's life.
PS -- Just calling the cops and saying "I killed someone" does not mean the state has nothing to prove. The police are going to investigate to make sure the physical evidence backs up the statement, and there may be a trial anyway -- or I guess you have never heard of there being a trial even when there has been a confession? Happens quite frequently.
But I guess you "don't get it".
