but it can't be used 'all brand new' after trial, if I correctly recall trial rules. So yes, in spite of expert testimony during trial that he's at a certain stage of alzheimers, and cross examination by Smith that he knew what he was doing before and during his proven crimes, they might be able to win this on appeal. But if the Smith team loses on appeal, after all that justice and genius of the DOJ Smith team, the People of the United States are screwed.

I hear ya, FN. I'm totally with you on the whole thing.
Though we have no control over any of this, I'm just praying to God that justice be done and he never gets a mistrial break.
