To pass the ACHA, the Senate only needs a simple majority vote of 51. Filibuster votes of 60 are not relevant in this situation.
Now if Mitch wants to change the Constitution to make republicans a permanent majority, or alternatively if they have a minority vote, they win anyway, let him knock himself out.
