As a member of DOJ he is bound by DOJ norms and rules. As a member of DOJ if his testimony violates DOJ policies then Merrick Garland can respond. As a private citizen DOJ has no right to respond to Hur. Plus, Hur brought his own pro-Magat attorney with him.
