The Missouri Court of Appeals rejected the appeal, because it concluded that the jury that heard the case was well qualified to do so. It then refused to rehear it. The Missouri Supreme Court next refused to hear the appeal at all.

SCOTUS first got this petition in September, but it hung around for 6 months, likely awaiting Alito's completed 'opinion' for all of that time, since even he agreed that the case should be denied cert.
