(1,685 posts)You are getting them mixed up with the NY STATE attorney general or other state prosecutors in NY. THEY (NY STATE attorney general or other state prosecutors in NY), not any federal prosecutors, will handle state criminal violations, which are not pardonable by a president. Based on news reports, state criminal violations are expected, and again, they will be prosecuted by NY state prosecutors, not federal.
As for the SDNY, that office prosecutes ONLY federal crimes, which ARE pardonable by a president. Trump could issue pardons in advance of any possible indictments (like Ford did with Nixon) that would cover any federal crimes committed to that point. That would end any prosecutions for anybody pardoned by Trump, except for crimes newly committed after the date of any pardons.
