Washington (CNN)An Alabama law that prohibits a type of surgical abortion that is clinically referred to as Dilation and Evacuation will remain blocked after the Supreme Court declined on Friday to hear the case, but Justice Clarence Thomas made clear he wants the court to consider rolling back historical precedent on abortion.
The West Alabama Women's Center, represented by the ACLU, argues the law prohibits physicians from performing and abortion using "the most commonly used method for performing pre-viability second trimester abortions."
In court briefs they argue that "starting around 15 weeks" D&E is the "only abortion method that can be performed outside a hospital; it accounts for 95% of second-trimester abortions nationally and 99% of abortions after 15 weeks in Alabama." They also dispute the robustness of the health exception for women.

Senator Bernie Sanders first executive order as president would be to close Americas private detention facilities, which are part of an ongoing row over the treatment of child migrants, his wife and senior adviser, Jane Sanders, has said.
Jane Sanders was outside a detention facility in Homestead, Florida, along with several 2020 Democratic candidates voicing upset at the immigration policies of Donald Trump.
Jane Sanders told the Guardian it was heartbreaking to see the Homestead facility firsthand and outlined what the Vermont senator who is one of the 2020 frontrunners to take on Trump would do if he won the White House.
The first thing one of the things that he says hell do as president the first executive action hell take is to shut these down, to shut down the child detention centers across the country, she said.
Sanders said her husband has a forthcoming immigration plan informed by Latino staff members and immigrant activists. She also he had voted against legislation that led to the creation of the Immigration and Customs Enforcement (Ice) agency in 2002.............................

The labor union for federal asylum officers is condemning President Trump's policy of sending migrants to Mexico as they wait for their assigned court dates in the U.S., calling the Trump administration's program "fundamentally contrary to the moral fabric of our Nation."
The asylum officers, who are tasked with carrying out a policy widely known as "Remain in Mexico," said they have a duty "to protect vulnerable asylum seekers from persecution," claiming that Trump's policy creates a conflict between their professional responsibility and the president's directives.
The policy formally known as the Migrant Protection Protocols is a "widespread violation" of international and domestic law, the asylum workers' union wrote.
"[The Migrant Protection Protocols program] violates our Nation's longstanding tradition and international treaty and domestic obligation not to return those fleeing persecution to a territory where they will be persecuted," the union, the American Federation of Government Employees Local 1924, wrote to the 9th Circuit Court of Appeals in an amicus brief filing.
It is significant and unusual for a sitting president's own federal workers to publicly criticize a policy they have been directed to follow. The asylum officers say the MPP program undercuts a core part of their job and may endanger the lives of asylum-seekers, so the officers are asking the federal appeals court to halt the program. ............................

Both the Senate and House have now passed legislation delivering billions of dollars to address the growing humanitarian crisis at the southern border. But lawmakers have no agreement on how to reconcile those bills before a recess set to start on Friday.
The Senate passed a $4.6 billion emergency spending bill on Wednesday, one day after the Democratic House approved its own competing legislation. House and Senate Democrats immediately then began urging Senate Majority Leader Mitch McConnell (R-Ky.) to enter into negotiations to craft compromise legislation.
But McConnell was noncommittal and may simply leave Speaker Nancy Pelosi with a take-it-or-leave-it decision heading into the July Fourth recess. McConnell would only say Congress "is going to try to get it finished this week" when asked if he'd enter into talks with House Democrats.
McConnell's chief deputy said House Democrats have proposed changes to the Senate bill that would make it more palatable to liberals, but said Republicans are unlikely to support them. Democrats are seeking to reimburse local governments and organizations that offer support to migrants and also limit to 90 days the amount of time that unaccompanied minors are kept in temporary shelters at the border, among several changes requested by Pelosi. .................................

Far from moving to ameliorate the treatment of small children that has become a national story, the president is telling senior aides to stick to blaming Democrats and Obama.

As news broke on the reportedly horrific conditions at a Texas detention center holding migrant children, President Trump did what he normally does in times of crisis and public-relations hellscapes: He monitored the media and political reactions via his White House TV and the DVR device he dubs his super TiVo.
And in the days since the treatment of small children at this detention facility became major national news, the president wanted to make one thing clear to his subordinates, though his focus was not at all about ameliorating appalling conditions. Trump has repeatedly told advisers and senior aides that, no matter how great the public outrage toward his administration, his lieutenants were to stick to a simple strategy of blaming Democrats and Trumps predecessor, Barack Obama, according to two people with knowledge of the exchanges.
In the end for Trump, the dire situation was a mere messaging problem.
The strategy was a practical Xerox of the presidents approach to other immigration scandals of the Trump era, such as the brutal, widely condemned family-separation policy. When the president and his team dont want to own the negative coverage and political backlash to the treatment of migrants, asylum-seekers, or undocumented immigrantsbut also want to continue draconian policies nonethelessthey frequently revert to trashing the Democrats as the real culprits.
