Democratic presidential candidate Hillary Clinton violated federal records rules through her use of a private email server while she was secretary of state, a State Department audit has concluded.
"At a minimum, Secretary Clinton should have surrendered all emails dealing with Department issues before leaving government service," says an audit by the State Department Inspector General, obtained by NBC News.
"Because she did not do so, she did not comply with the [State] Department's policies that were implemented in accordance with the Federal Records Act."

But the findings on Clinton are sure to reverberate through the 2016 presidential campaign. The State Department's auditors challenge some of the fundamental assertions Clinton has been making about why her use of personal email for government business was not improper.

(15,805 posts)and it shouldn't be at all unusual that the the former SoS relied more on digital communication than her predecessors. Certainly the use and dependence on emails and other forms of digital communications has increased significantly through each administration, and will continue to grow exponentially in the future.
The government as a whole is completely unprepared to handle the complex IT system it needs. There is no cabinet level IT office, not even an IT czar or chief, and all the while the digital world is exploding as users demand more and more.

(15,805 posts)There probably a reasonable argument to be made that she pushed the envelope at the time, and if you're going to try an hold up Kerry by comparison, then keep in mind that there was not an explicit, categorical prohibition against federal employees using personal emails when Clinton was in office. It wasn't until there was a major overhaul to the rules in 2014 -- which postdates Hillary's time at the State Department -- that explicit limits were placed on agency officials using private email accounts for official business. It was only after she left the State Department, that the National Archives issued a recommendation that government employees should avoid conducting official business on personal emails.

(12,504 posts)SO, no formal, consistent, modern protocol in place when Hillary was SoS, and making up the rule as they go along, creating new and applicable rules after Hillary leaves her post as SoS, and an verbal indictment of email habits in hindsight. Got it.

The State Department asked Powell to try to receive relevant emails from his internet provider, but "as of May 2016 the Department has not received a response" from Powell, the audit said."

(14,732 posts)Powell is well respected on both sides of the aisle. He did it and hasn't even bother to reply to a request from State. I imagine he was more interested in carrying out his job. Hillary likewise.
