Irving case where newborn was left to die in porta-potty “screams out for moral outrage”
A Dallas County jury is hearing testimony today in the trial of an Irving school custodian who raped and impregnated a 13-year-old family member, and is accused of letting the girl’s newborn baby die in a porta-potty.
A jury deliberated for less than 10 minutes Wednesday before convicting Mauricio Hernandez, 54, on a charge of aggravated sexual assault of a child.
Jurors are now hearing testimony to determine his punishment in the court of state District Judge Ernest White. Hernandez faces from 5 years to life in prison, but he also faces a related capital murder charge for allegedly abandoning the baby. Prosecutors will ask jurors to consider evidence of the capital murder charge in their sentencing decision.
Hernandez had sex with the girl and then gave her pills to terminate the pregnancy in April 2013. The girl, then 14 and eight months pregnant, and went into labor in the parking lot of a soccer field, where she and her brother played the sport.
