The prime suspect in the Boston Marathon attacks has asked a US court to move his trial to Washington, DC claiming he will not be tried fairly in the northeastern city.
The April 15, 2013 attacks, which killed three people and injured 264 others, were allegedly planned and carried out by ethnic Chechen brothers Tamerlan and Dzhokhar Tsarnaev.
Tamerlan was shot dead by police on April 19, 2013, after killing an officer.
Dzhokhar is due to stand trial in Boston in November, accused of 30 federal charges and could face the death penalty if convicted.

(17,055 posts)But he has no right to have his trial moved from Massachusetts where he perpetrated his crimes, imho. At least I hope not. He would get a fair trial here. No doubt about it.

So yeah, the victims weren't given any consideration. However, what this kid's life was like with Mr. Jihad, his older brother, should be explored.
I'm a bleeding heart liberal in this one. Do I think he should be released? Oh, HELL no. I think the DP should be off the table, though.

Maybe he should ask to have it moved to NM. We got rid of it, finally.

(6,241 posts)Im ok with this kid not getting the death penalty. I dont care about his rights, you understand. But as young as he is he has royally screwed up his life. Hell never get married. Hell never have children. Never do anything productive. He will be in a cage forever.
You sentence him to death, and you give him something to do. Hell be working with his lawyer on his endless appeals. You sentence him to life without the possibility of parole, and he has nothing to do except breathe and try to escape prison rape for one more day. All of his decisions for the rest of his life will be made by someone else. And as young as he is, that is going to be a long time.

(11,360 posts)If the evidence shows him to be guilty, it will be just as convincing in DC as it would be in Boston.

(58,179 posts)If I were on his defense team, this would have been the first motion I filed. If he gets a Boston-based Jury, he's dead before the opening gavel falls.

(21,130 posts)I think when he get's a Jury based out of anywhere, he's dead* before the opening gavel falls.
* I am hoping "dead" translates into life in Florence ADMAX with Terry Nichols and Zacarias Moussaoui.

(22,000 posts)but the judge does not have to grant the motion unless they can prove a substantial disadvantage in Boston. I frankly don't think it will matter. I also hope he doesn't get the DP.

Even before their trial, it was obvious that these young men -- really boys at the time of the crime -- were guilty. They all confessed. The whole thing was in the newspapers. There were no two sides to it. Then they were tried and convicted. Guilty.
It was obvious that they were guilty until they'd served most or all of their sentences and then the real rapist confessed and DNA tests were run and their cases were brought back to court and their convictions were vacated.
I am not convinced that Dzhokhar Tsarnaev is guilty. Not saying he's innocent, just that picture we get is only the one we're shown, and it may not tell the whole story.
