Trump asks judge to delay enforcing $83M verdict in Carroll lawsuit

Former President Trumps lawyers asked a New York judge Friday to pause the verdict that would require him to pay columnist E. Jean Carroll more than $80 million for defamation, arguing his appeal would likely reduce or dismiss the case entirely.
In a court filing, the lawyers asked Judge Lewis A. Kaplan to suspend enforcement of the fines until a month after Trumps post-trial motions which are due by March 7 are considered. Otherwise, according to the court documents, they asked for a partial stay, which would only require Trump to post bond for a fraction of the fees.
The request comes after the former president was ordered to pay $83.3 million earlier this month for defaming Carroll in 2019, after he repeatedly denied her sexual assault allegations. Trump was found liable for sexual battery and defamation in May. The latest fine marks the second time the former columnist has won damages from Trump at trial. Last year, the former president was ordered to pay $5 million to Carroll for defaming her over a separate comment.
Carroll celebrated the verdict, calling it a win and a great victory. This is a great victory for every woman who stands up when shes been knocked down, and a huge defeat for every bully who has tried to keep a woman down, she said.

(134,464 posts)There has been a lot of huffing and puffing about "appeals" but I don't think one has actually been filed yet for the $83 million - thus the request to "delay the verdict". I think the clock on that is coming up (verdict was handed down January 26, 2024).

(4,587 posts)with the talking head "experts" giving out misinformation about how things can go post judgement. There are specific legal strategies to delay and contest bond amounts, appeals of denials of those motions, requests for stays pending appeal of those motions to modify the bond requirements etc. Some of this can resolve quickly or it can be dragged out on a busy court calendar. But there were ones claiming he had to pony up bond for the full amount, or full amount plus interest, or the full judgement amount if he couldn't bond, or the full amount plus interest. "Experts" were hollering this all had to happen within 15 days or else the lawyers could move to seize assets. So we're well beyond 15 days and now what? More legal filings etc. I said at the time I was curious as to what the legal procedures really allowed for in requesting modifications of appellate and bond requirements. Just like with the NY case I want to know about specific steps and timelines for the legal filings post judgement, during the 30 day window for appeal and after a default of the appeal period window.

(149,623 posts)TFG does not have the cash to bond this claim. I suspect that TFG will be filing bankruptcy soon. It makes no sense to file a bond for Carroll if TFG is going to have to file bankruptcy anyway due to the NY AG civil fraud judgment.

"Trump wants a stay of the execution of judgment in Carroll until after resolution of his post-trial motions," reported Politico legal analyst Erica Orden. "In other words, he is asking Judge Kaplan to let him hold off on paying the $83.3M judgment until after his post-trial motions are decided."
Carroll, a writer, alleges that the former president raped her in a Manhattan department store in the late 1990s, although she doesn't recall the exact date. Trump has responded by saying that he doesn't know who Carroll is and that she is fabricating the accusation in order to sell books......
All of this comes on top of Trump facing a separate $350 million judgment, plus interest, for civil fraud in a case successfully litigated by New York Attorney General Letitia James. In that case, Judge Arthur Engoron found that Trump and his two adult sons, with the assistance of their longtime chief accountant Allen Weisselberg, systematically lied about the values of Trump Organization properties in order to manipulate tax liabilities and loan conditions.

(134,464 posts)but the judgement was against his brand-named organization, although we know that he supposedly can't try to file bankruptcy to evade the judgement (we have been watching Alex Jones try to do that vs Ghouliani who is doing a personal bankruptcy).
