Trump legal brief: Judge Engoron says Trump's lawyers 'whistling past the graveyard' on possible fines

Judge Arthur Engoron chides Trump’s lawyers over their claim that he shouldn’t be fined as punishment for financial fraud committed in New York. A federal grand jury in Georgia indicts an Alabama man for making threats directed at Fulton County District Attorney

Engoron has already found Trump, his adult sons and their family business liable for years of financial fraud relating to the overvaluation of their assets. The ongoing trial will decide what penalty the defendants must pay.

“Several witnesses have testified that they would have acted differently had they known the statements of financial condition were fraudulent,” Engoron responded.

“I think, to a certain extent, the defendants are whistling past the graveyard here,” the judge added.

Why it matters: Coming on Halloween, Engoron’s “whistling past the graveyard” characterization of how Trump’s lawyers view the threat of large fines and other sanctions should spook the former president.

I think -given the last few days of Trumps tweets--Trump is already spooked.
But no one is talking jail time--at least not yet.

NOTHING ELSE has gotten through to him. Not warnings. Not second and third warnings, not fines, NOTHING. Some time in custody might finally make an impression.

They’re afraid it will cause violence but just now we’re learning of another MAGA arrest for threats against the Fulton County DA. There’s already violence but this treating him with kid gloves says that no one is above the law is a myth

He can't send him to jail, because this is a civil case, not a criminal case. (The criminal case in NY is the one being brought by the DA of NY County, Alvin Bragg, related to the hush money payments.)

The judge ruled weeks ago that the Trump Organization et al had committed financial fraud. The purpose of this hearing has been to determine how much $$ they'll have to forfeit for their actions. The NYAG is asking for a $250,000,000 fine (or thereabouts) aka 'Disgorgement', as well as doing away with the ability of the Trump Organization to do business in NYS. (That's referred to as the corporate death penalty.)

BTW, it was reported that Kise, the main attorney on the case, received a $3 million deposit before he would take the case. Trump also had to pony up the $5,000,000 award in the Jean Carroll case before he could even file his appeal of the judgement, under an option available to a federal court judge. (It's in a trust, not in Carroll's hands yet.) So, when his neck is on the block, he finds the cash.

If thy want to keep being paid (are they actually being paid?) they have to go along with his delusional view of reality. It's an amazing balancing act considering they also face legal jeopardy when they cross legal lines. Talked a very special mindset to represent Trump.

A rational person would try not to antagonize the judge so as to minimize any kind of judgment.
