Wrong Turn Leads to Woman Being Shot

A woman in Hebron, Washington County ended up in the wrong driveway while searching for a friends house, and was shot to death, investigators said. It happened Saturday night on Patterson Hill Road in Hebron.
The woman, Kaylin Gillis, 20, was with friends, investigators said, when the group mistakenly turned into the driveway. They were leaving when Kevin Monahan, 65, allegedly shot them.
The group drove several miles to get cell service in the rural town and call for help.
Monahan is now being held in the Warren County Jail on second-degree murder charges.

Please note the details of the report. Everyone stayed in the car. They pulled in driveway, then right back out. The homeowner shot at the car while the people were LEAVING. He was under no threat at any time.

(576 posts)Some people are commenting that they're upset he's only been charged with 2nd degree murder. I suppose it's not 1st because they would not be able to prove premeditation? I fear he will be able to plea to manslaughter. If he does not end up with a felony, does he get to keep his guns? Purchase more after he gets out of jail?

(260 posts)There are three witnesses to the shooting, and the shooter was clearly violating NY's requirement that a homeowner has a duty to retreat. Plus, MAGA man held a standoff with cops for two hours before he finally gave up. Should be an open-and-shut second degree murder conviction.

Courts have held that premeditation and deliberation can be formed while the killer is literally pulling the trigger.

(5,844 posts)The GQP needs fear to keep their followers. Fear craves authoritarianism. Ramp up the fear, then sell the people on being the authoritarian figure that can make the bogeyman go away. Then do nothing to fix the problem they created and watch the fear continue to escalate from these types of shootings. It's a vicious cycle.

At a K9 benefit motorcycle ride last year, he made transphobic statements. He spent the summer holding "rallies" with our Republican assemblyman getting people ginned up about their 2nd Amendment rights. He distributed signs to local businesses so they could advertise that they welcome concealed carry customers.
And when his pro gun/hateful ideologies promote more violence, he will be sure to blame the "soft on crime" Dems.

It will take putting the fear in those fearful people by arresting and with a very speedy trial convicting them and executing as many as possible.
I believe this is the only way to stop this crap, as long as they get to bond out of jail and go back home and make love to their weapons this will never stop. It have to be put in everyones mind that shooting someone is WRONG.

Turn around in someones' driveway, mistakenly go to the wrong house and knock on the door or get in a trivial argument, beware, there is a good chance you are going to be shot courtesy of the second amendment asholes.
God, how I hate these gun people for what they have turned our country into.

(45,466 posts)sometimes GPS/maps navigate me to someone's driveway that is in between me and where I'm trying to go. Homeowners will put up snarky signs like they don't call 911, protected by Smith and Wesson, trespassers will be shot, etc.
It doesn't hurt the homeowner to have someone turn around in a driveway. But it can absolutely be deadly to the person making this mistake if the homeowner is a hateful psychopath.

(576 posts)The young people had to drive for miles to get cell service in order to call for help. Stefanik should stop spending so much time on culture wars and elevating her own power/status in the Republican party. This is a huge issue. A few years ago, an older couple died because they went off the road on the Northway and were unable to call for help. Cell service where I live (rural northern NY) is sketchy, so I'm forced to have a landline.

(9,070 posts)This is my generic response to gun threads where people are shot and killed by the dumb or criminal possession of guns. For the record, I grew up in the South and on military bases. I was taught about firearms as a child, and I grew up hunting, was a member of the NRA, and I still own guns. In the 70s, I dropped out of the NRA because they become more radical and less interested in safety and training. Some personal experiences where people I know were involved in shootings caused me to realize that anyone could obtain and posses a gun no matter how illogical it was for them to have a gun. Also, easy access to more powerful guns, guns in the hands of children, and guns that werent secured are out of control in our society. As such, heres what I now think ought to be the requirements to possess a gun. Im not debating the legal language, I just think its the reasonable way to stop the shootings. Notice, none of this restricts the type of guns sold. This is aimed at the people who shoot others, because its clear that they should never have had a gun.
1.) Anyone in possession of a gun (whether they own it or not) should have a regularly renewed license. If you want to call it a permit, certificate, or something else that's fine.
2.) To get a license, you should have a background check, and be examined by a professional for emotional and mental stability appropriate for gun possession. It might be appropriate to require that examination to be accompanied by references from family, friends, employers, etc. This check is not to subject you to a mental health diagnosis, just check on your superficial and apparent gun-worthyness.
3.) To get the license, you should be required to take a safety course and pass a test appropriate to the type of gun you want to use.
4.) To get a license, you should be over 21. Under 21, you could only use a gun under direct supervision of a licensed person and after obtaining a learners license. Your license might be restricted if you have children or criminals or other unsafe people living in your home. (If you want to argue 18 or 25 or some other age, fine. 21 makes sense to me.)
5.) If you possess a gun, you would have to carry a liability insurance policy specifically for gun ownership - and likely you would have to provide proof of appropriate storage, security, and whatever statistical reasons that emerge that would drive the costs and ability to get insurance.
6.) You could not purchase a gun or ammunition without a license, and purchases would have a waiting period.
7.) If you possess a gun without a license, you go to jail, the gun is impounded, and a judge will have to let you go (just like a DUI).
8.) No one should carry an unsecured gun (except in a locked case, unloaded) when outside of home. Guns should be secure when transporting to a shooting event without demonstrating a special need. Their license should indicate training and special carry circumstances beyond recreational shooting (security guard, etc.). If you are carrying your gun while under the influence of drugs or alcohol, you lose your gun and license.
9.) If you buy, sell, give away, or inherit a gun, your license information should be recorded.
10.) If you accidentally discharge your gun, commit a crime, get referred by a mental health professional, are served a restraining order, etc., you should lose your license and guns until reinstated by a serious relicensing process.
Most of you know that a license is no big deal. Besides a drivers license you need a license to fish, operate a boat, or many other activities. I realize these differ by state, but that is not a reason to let anyone without a bit of sense pack a semiautomatic weapon in public, on the roads, and in schools. I think we need to make it much harder for some people to have guns.

(205,619 posts)HEBRON The Washington County Sheriffs Office has charged a Hebron man with murdering a 20-year-old woman who was in a vehicle that had mistakenly pulled into the mans driveway.
In a news release issued Monday afternoon, the office said it has arrested Kevin D. Monahan, 65, of Patterson Hill Road, in connection with the Saturday night shooting death of Kaylin A. Gillis, of Schuylerville.
Monahan is being charged with felony second-degree murder.
She was an innocent young girl out with friends looking for another friends house. I know for a fact that she comes from a good family and know her personally. Shes a young girl that was taken way too young, Sheriff Jeffrey Murphy said at a press conference on Monday.
On Saturday at 9:53 p.m., a 911 call was received for a woman who had been shot in the area of Cemetery Road in the town of Salem, according to the news release. Subsequent calls came in reporting shots fired from a house on Patterson Hill Road.
Patrols arrived on scene to Cemetery Road in the Town of Hebron and began CPR, Murphy said. We then began getting calls of shots being fired on Patterson Hill Road in the Town of Salem approximately 5 miles away.
Deputies discovered that Gillis had been shot while in the vehicle. She was pronounced dead at the scene.
The sheriffs offices preliminary investigation concludes that Gillis was in a vehicle that had mistakenly pulled into the driveway where Monahan, the homeowner, was inside. He fired at least two shots from his porch, with one striking Gillis in the vehicle. The people in the vehicle drove away from that residence until they got to the Cemetery Road area where they could make a 911 call.
Theyre young adults, they were in the area looking for a friends house. Its a very rural area with dirt roads and its easy to get lost. They drove up this driveway for a very short time, realized their mistake, and Mr. Monahan came out and fired two shots, the sheriff said.
Authorities were not able to immediately speak with Monahan, the sheriffs office said.
Monahan was uncooperative with the investigation and refused to exit his residence to speak with police, the news release. He was later taken into custody with the assistance of the New York State Police Special Operation Response Team after several hours.
When asked about the weapon used, authorities declined to comment.
We dont want to talk about the weapon today, Murphy said during the press conference.
Murphy said Monahan was transferred to Warren County Jail as an administrative decision.
