Judge sanctions MyPillow CEO Mike Lindell for 'frivolous' election lawsuit

Source: Yahoo news

A U.S. district judge ordered MyPillow CEO Mike Lindell to pay some of voting machine company Smartmatic’s court costs and fees, saying in a ruling on Thursday that some of Lindell’s claims against Smartmatic fall “on the frivolous side of the line.”

“The Court agrees with Smartmatic that Lindell has asserted at least some groundless claims,” U.S. District Judge Carl Nichols wrote in his ruling.

“In particular, the Court concludes that at the very least Lindell’s claim against Smartmatic under the Support or Advocacy Clause falls on the frivolous side of the line (other claims do too). As a result, the Court orders Lindell and his previous counsel to pay some of the fees and costs Smartmatic has incurred defending itself and moving for sanctions,” he added.

...

"Whatever the judge thinks, that’s his opinion,” Lindell told Bloomberg Law in a phone call. “I’ve got lawyers doing more important things like removing these machines from every state.”

3. I couldn't agree more

It is obvious that this crowd, from their actions/in-actions the past five years, have absolutely no thoughts of obeying ANY Rule of Law. And on any of the major things especially, there hasn't been any enforcement what so ever......

Just like Trump's impeachments, I suspect that the Jan 6th hearings will come and go with nothing happening to anyone at the top...

It is like Anarchy...........

10. I agree. From Garland all the way down

Some will say, but but he's gathering evidence the right way. Slow and methodical. You just wait!!!

The hard truth is we live in an ever increasingly war between the budding of Fascism and Democracy. And what Democrats continue to fail to see is that being "right" and dotting all the i's and crossing all the t's in a quiet way behind closed doors and even if you do finally come out of the back room to state things like "most likely engaged in criminal behavior" IS NOT GOOD ENOUGH.

We live in a world of viral stories. In a world so dominated by the spectacle of social media and the latest conspiracy theories. Reactions have to be instant and more sensational than the original story. And we don't even have to make anything up to create a sensational headline. That's the difference. We could jail McCarthy over not honoring a subpoena. That would cause a sensation. Cause some discussion in the nation, and asking why shouldn't a lawmaker have to abide by the law. But Democrats are so afraid of the fight that would come. They seem as though they'd rather not get their hands dirty, or look dishevelled on TV.

Maybe I'm wrong. Maybe they'd tell us they were fighting as hard as they can to counter all the misinformation and lies. But what actually matters in this crazy world is perception. And they should be aware that the perception of too many traditional Democratic voters is that the Republicans are winning the war of information/misinformation even if they do it by manufacturing passion and righteous indignation for the cameras. "When they go low, we go high" just will not work anymore. And I'm sad to have to say that. But its true.

20. Yeah kind of.

The OJ Simpson lawyers won, even though the prosecution had irrefutable DNA evidence. Spectacle won out over facts. "If the glove does not fit....you must acquit!"

Republicans have known this for a long time. I think that Democrats have always felt, and with good intentions, that they don't need spectacle to win their arguments, all they need is to calmly lay out the cold hard facts. That they don't need to lower themselves to create "unnecessary" drama to make a point. Well, now it is necessary.

Michigan state Sen. Mallory McMorrow showed the way. When was that last month now? A lone wolf. We have to be continually creating viral content which hits back hard. Almost every %$%#@#$ day!

22. Not blaming Garland here. (just want to make that clear)

What i'm saying is, we've had some good judges rulings in our favor, BUT This cult (for some reason) is NOT being punished like i think they should be. Court APPEALS are killing us. (just no end to them) I'm saying JUDGES need to be MORE on the spot with their decisions. PAY NOW type a thing!

4. So Lindell's lawyers are busy removing the Smartmatic voting machines from every state.

Smartmatic machines have a paper backup, making them auditable. I suppose Lindell and whoever (Trump) is egging him on want to replace all machines with ES&S machines that do not have paper trails and whose programming for tabulating votes technically can be manipulated by unscrupulous elections staff—not that we have any reason to suspect any Republicans to be unscrupulous!

Edited to add: Democrats need to introduce a bill requiring all states to use voting machines with a paper backup for auditing purposes in all federal elections, and provide funding to help states replace old machines. Republicans who vote against such a bill clearly do not want voting systems that can be audited.

14. They Are Removing Nothing

It's just another fantasy puked out by a brain damaged addict.
I don't know who is paying these lawyers he claims to have, but it's not him.
He never had enough money for this, and his share of corporate value has fallen at least 30%.
Either he's dead broke, or he's just the frontman for crazy rich people.

16. Why don't the Democrats take advantage of machine mistrust and go back to paper ballots?

Frankly, I don't trust that way of vote tabulation either. Not because of the machines themselves won't do their job properly if left alone, but that its been proven over and over how easily they are to hack.

I think for instance McConnell's repeated overwhelming wins despite being behind in polls, is highly suspicious. Not to mention the whole debacle in 2000 in Florida. Different type of machine, but still that was used to influence rulings.

And its a myth purported about paper ballot counting as taking too long. You just hire or get enough volunteers for each riding. We do it in Canada. We get our election results the same evening of voting day, other than a few close calls.

Introduce a bill that says that for the next possible election, may not be until the Presidential one now, that the country will go to paper ballots...."because of all the concern about voting machines" Heck get Mike Lindell to endorse it! I'd love to see McConnell squirm and make his excuses about why we should trust the machines. It would cause a divide in the GOP.

23. Well, here's the thing

Smartmatic was only used in one county in one state--in the entire country--during the 2020 election. Los Angeles County was the only location to use Smartmatic.

This is why Smartmatic's defamation suit has got legs, and why Lindell is scared.

5. PillowMan best get used to paying, and paying, and paying...

...because he's going to be doing a lot of that for years to come. He's on the hook for something like $2B to the voting machine companies. He's so broke that he just sold a shitty '80s-vintage corporate jet for 1000 times less ($2M) to "raise funds". Lindell's not looking like a big dough roller lately.

11. Why does he have to pay only "some" of the court fees"?

the opposing party is losing money because his crazy lying ass lied about voting machines. He should pay all the court fees and then some, to make up for the loss of time.

21. It is his modus operandi

In his commercials he guarantees that his sheets, pillows, assorted crap will be the most comfortable you'll ever experience ever! He guarantees it! So I think once in court his defense might rely upon his using his history of hyperbole as a defense, stating this is just his way of expressing himself and trying to sell his "product" in a time honored manner. And deep down, everybody knows he's full of hogwash, and whatever he says isn't true, but that's just the way he is, plus he is so charming that people overlook his tendency to "exaggerate", and buy his products anyway.
Because you know, cancel culture (which for him even includes those dirty banksters now!) is trying to destroy him which is why his ads are full of American flags and blessings from God so his true believer customers can buy his 75% off crap and help support his struggle against... well anybody who is not a fascist, I guess!
