Pennsylvania Bill Would Reduce Welfare Benefits For Women Who Cannot Prove They Were Raped

A Pennsylvania House bill seeks to limit the amount of TANF assistance that low-income women receive based on the amount of children they give birth to while covered under the program.

Despite the fact that low-income women who give birth to children would logically need increased assistance to care for their larger family, Pennsylvania lawmakers — State Reps. RoseMarie Swanger (R), Tom Caltagirone (D), Mark Gillen (R), Keith Gillespie (R), Adam Harris (R), and Mike Tobash (R) — don’t want their state’s welfare program to provide additional benefits for that newborn. If a woman gives birth to a child who was conceived from rape, she may seek an exception to this rule so that her welfare benefits aren’t slashed, but only if she can provide proof that she reported her sexual assault and her abuser’s identity to the police:

In determining the amount of assistance payments to a recipient family of benefits under the Temporary Assistance to Needy Families (TANF) Program, the department shall revise the schedule of benefits to be paid to the recipient family by eliminating the increment in benefits under the program for which that family would otherwise be eligible as a result of the birth of a child conceived during the period in which the family is eligible for benefits under the TANF Program. [...]

Elimination of benefits under subsection (d) shall not apply to any child conceived as a result of rape or incest if the department: (1) receives a non-notarized, signed statement from the pregnant woman stating that she was a victim of rape or incest, as the case may be, and that she reported the crime, including the identity of the offender, if known, to a law enforcement agency having the requisite jurisdiction or, in the case of incest where a pregnant minor is the victim, to the county child protective service agency and stating the name of the law enforcement agency or child protective service agency to which the report was made and the date such report was made.

and contraception, because to them contraception is just another form of abortion. I know this bill is specifically naming "rape" but it really goes back to getting closer to overturning Roe V. Wade.

I also think that a lot of the Teabagger's don't think rape happens, wink, wink, nod, nod.

Unfortunately the only way we can get rid of Corbett is through impeachment and not a recall. If Kane does her job correctly (once elected) she will investigate Corbett's inaction(s) in regard to the Sandusky case, his pressured removal of the Secretary who oversees our State Parks System (which is a beautiful system), a bill sitting on his desk that would allow new companies to forward only 5% of their employees state income taxes (keeping the other 95% for the company). I could go on and on, but it's time to get rid of Corbett.

you can't have it both ways. either you support a woman's right to choose or you don't... but if you are going to force a woman to have a kid, then damnit you should be willing to help support the kid.

First they want women to have children. No family planning.
No abortions.

Now they only want the state to help provide for the children
if the children are the result of a rape. Is this a large population
we're talking about here gentlemen?

Is this compassionate conservatism?

Oh! Wait! These children are intended by God's will, so THAT's
why they want the state to help them.

No, that was in Indiana.

Sometimes it seems like God has 50 different state plans
to guide these GOP lawmakers.

If they are going to essentially ban women from pregnancy while recieving TANF, then they better be paying for birth control.

But somehow I don't think that benefit will be included, as the bill is intended to shame & punish.

means that if she knows who did it, she must report who it was. If she doesn't know who it was, then it becomes ambiguous. She can say she doesn't know, but now it could be challenged and she would have to prove it.

Why don't we have universal health care period, and do away with all this stupid needling, time wasting, costly, nonsense?

In any real sense. Yes, testimony must be provided but via affidavit. It isn't a high factual burden. However, it is testimony and can be used to impeach her later or prosecute her for perjury.

The bigger problem, in my opinion, is that she must testify that she reported the rape. In other words, if you don't report it as rape for whatever reason (including legitimate reasons such as safety concerns), then you will be denied benefits.

Shitty, shitty bill. For several reasons.

More of the same...punish those without a lobbyist or any political power, cow-tow to the influential...I wish they spent this much time getting in the short hairs of Clean Air & Water violators, deceptive bankers, payday lenders, pick your constituent. Really screwed up priorities PA...way to go! And here I was embarrassed all our governors here in IL are in jail lol!

The only Democrat signed on as a sponsor to this horrific piece of shit is 70+ year old Tom Caltagirone, who has been in the House for nearly 40 years - both a dinosaur and a DINO.

The love affair between Democrat Thomas Caltagirone and Gov. Thomas Corbett goes back a few years. I exposed him for sending a $500 campaign contribution to then Attorney General candidate Corbett the first time he ran for that office. I earned scorn and retribution from the State Representive and Democratic Chair of the House Judiciary Committee for that work. While I was brought up on charges of being a "bad Democrat" for releasing information on how a sitting Committee man gave material support to a Republican, he was never pursued by Berks County Chair Tom Herman.

He explained his donation numerous times by explaining to me that it was Corbett who got him off on charges he had lounged on a sofa in his District office naked one day awaiting a female staffer. When she entered and found him she ran out with the State Representative allegedly chasing her down South 10th Street in Reading.

No wonder the two Toms get along so well: one is in bed with the church and one with the gas industry. Both are sellouts who work against women and children in Harrisburg. Their cozy relationship goes back and Caltagirone's statement in support of Corbett defies logic and reason considering the enormous negative impact of this Governor.

Of course Corbett isn't the only Republican aided and abetted by Reading's resident scoundrel. After Dems finally regained a one vote majority in the House he infamously crossed the aisle and voted for (now) convicted felon John Perzel for Speaker.

So Tom Caltagirone supports the agenda being pushed out of the Governor's mansion? It's time either for this dinosaur to retire or for a real Democrat to send him there.

Now, the State can determine how much each welfare recipient will get, but the Federal Government will pay 50% of what the state sets, PROVIDED the "State Plan" for TANF is accepted by the Federal Government. If the plan is NOT accepted, it must be adjusted if the State wants reimbursed not only for the Cash Amounts but also any Medical care paid for by the State for the Welfare Recipient.

Notice the requirement that the plan meets FEDERAL SPECIFICATIONS, if it does not the Plan has to be amended. The agency that determines if the State Plan meets Federal Requirement is the Federal Department of Health and Human Services (HHS). There is no appeal from a HHS determination, thus if the plan contains a clause in violation of Federal Law, the State will NOT get any reimbursement (i.e. the State will have to assume all welfare costs).

In Pennsylvania the Welfare grant for a "Budget Group" (The state name for a "Family&quot of one, the PA Welfare amount is $226 in Philadelphia, $206 in Pittsburgh, $174 in Johnstown, the rest of the Counties in the State has between the Pittsburgh and Johnstown amounts. The Federal Government thus will pay $113 to the State for every TANF recipient in Philadelphia, $103 for each one in Pittsburgh and $ 87.5o for each recipient in Johnstown PLUS one half of the State reimbursements for Medical Costs.

Now, under the Affordable Care act (Obama-care) the Federal Government will pay 100% of the medical cost for those people on Welfare but that kicks in next year.

There is no way the State will accept all the costs of Welfare nor will it cut off Welfare to Women with dependent Children (the only groups eligible for the Federal TANF program). Thus this is political grandstanding, nothing more.

These people go after Tail ban laws and then try to implement the same thing....Maybe someone needs to bring charges against men that rape and get the girl pregnant. Or even with no rape they should bring charges against me....coherts in crime (with those person hood laws).

Some bills are simply evil. This is one of them.

I know that this goes along with the "women getting rich off of welfare by having more babies" meme, but c'mon! Do the math. And then when you've finished doing that think who really gets screwed on this one...Those little babies you're always mewling about when they're fetuses.

Of course, none of these folks give a rip once the kid leaves the birth canal.

A term I don't use lightly. I am aghast at the fact that a sufficient number of people exist who share these opinions to make it possible to elect cretins who would propose such laws. The Will to Evil is strong in this country; it needs to be confronted and destroyed. Lots of luck with that.
