U.S. Marine Major Christopher Warnagiris arrested for participating in Capitol riot

An active-duty U.S. Marine officer was arrested Thursday and charged with using violence against police during the Jan. 6 invasion of the U.S. Capitol by a mob of supporters of then-President Donald Trump. Major Christopher Warnagiris, 40, is accused of pushing his way past a line of police protecting the Capitol and forcing his way through a doorway in the East Rotunda of the Capitol.
Warnagiris, a Woodbridge, Virginia, resident who is stationed at Marine Corps Base Quantico, is charged in federal court with assaulting, resisting or impeding certain officers, obstruction of law enforcement, obstruction of Congress, violent entry of Capitol Grounds, and entering or remaining in a restricted building without lawful authority. He faces a maximum possible sentence of 20 years in prison if convicted of the charges, which will be prosecuted in federal court in Washington. He will make his initial court appearance Thursday afternoon in U.S. District Court for the Eastern District of Virginia.
Court documents say that after Warnagiris violently entered the Capitol he positioned himself in the corner of the doorway and used his body to prop the door open and pull other rioters inside. Video surveillance footage shows Warnagiris pushing a cop who tried to shut the door, according to a criminal complaint.
The Marine Corps, in a statement confirming that Warnagiris is on active duty said, The Marine Corps is clear on this: There is no place for racial hatred or extremism in the Marine Corps. Our strength is derived from the individual excellence of every Marine regardless of background. Bigotry and racial extremism run contrary to our core values.

If is unlikely that a Major has the twenty years needed to retire.

(756 posts)under the UCMJ for Conduct Unbecoming. This way he gets a Big Chicken Dinner and leaves without his oak (for those not in the know, you usually revert to last officer grade honorably held if convicted of felony or felony equivalent charges).

To quibble a bit, officers cannot be adjudged a BCD or a DD (Dishonorable Discharge). The equivalent sentence for officers is a dismissal. It's a distinction only a JAG could care about.

(756 posts)used the other terms for those who don't know. I don't remember if you get to retire with full pension at 20 if the dismissal was for very serious felonies. Any JAG folks who know? Even if he does get a pension it will be as a Captain (O-3) and not Major (O-4) if convicted.

edited to explain- 6 months forfeiture of wages, 6 months in the brig (sometimes with hard labor) and a dis-honorable discharge.

Commissioned officers cannot be reduced in rank by a court-martial, nor can they be given a bad conduct discharge or a dishonorable discharge. If an officer is convicted by a general court-martial, then that officer's sentence can include a "dismissal", a separation carrying the same consequences as a dishonorable discharge for an enlisted person and a reduction in rank to the last rank at which the officer served satisfactorily. A US Treasury decision states that even though an officer is dismissed rather than dishonorably discharged, the phrase "discharged from the Armed Forces under dishonorable conditions" is broad enough to include a dismissal rendered for an officer by a general court-martial, and thus a dismissed officer is also prohibited from possessing firearms or ammunition under federal law, in the same manner as a dishonorably discharged enlisted person

Nice to see theyre against bigotry and racial extremism (whatever that is), but the lack of mention of insurrection against the United States is the loudest silence.

(50,557 posts)First, we can probably hang an Article 86 (Absence Without Leave) charge on him. It's not likely he filed a leave form before he went to overthrow the government.
Article 88: Contempt toward officials
Article 92: Failure to obey order or regulation
Article 94: Mutiny and sedition
Article 95: Resistance, flight, breach of arrest, and escape
An Article 107: False official statements might also fit if his boss asked him where he was on 1/6 and he said anything but, "Sir, I attempted to overthrow the government."
Article 114: Endangerment offenses (basically, if you get into a fight this is what they use against you. They used to call it Dueling but it's been expanded.)
Article 116: Riot or Breach of peace
Normally the military will allow civilian prosecutors to handle cases committed off post UNLESS what you did is also covered by the UCMJ and the punishment the UCMJ allows is greater than the civilian punishment would be. Upon conviction, if you go to jail you will receive your service's equivalent of a Chapter 12 (Misconduct) discharge. But in this case, I think the Marines will take jurisdiction over this one since his crime was committed on federal property and the public will be expecting the Marines to clean up some of their own messes.
