3 Wisconsin Residents Sue Gov. Evers Over Mask Mandate, Say It Violates 'Rule of Law'

Three Wisconsin residents, on Tuesday, filed a lawsuit against Governor Tony Evers' recent emergency health order mandating masks statewide, suggesting that the order violates the "rule of law" in the state.

The Wisconsin Institute for Law and Liberty (WILL) filed the lawsuit on behalf of the three residents in the Polk County Circuit Court.

"This lawsuit is not about whether masks are good or bad, or whether Wisconsin ought to do more, or less, to address COVID-19. It isn't even about whether the state should have a mask mandate. This lawsuit is about our system of government and the rule of law," Rick Esenberg, WILL president and general counsel said in an email sent to Newsweek. "Governor Evers cannot seize these time-limited emergency powers more than once without legislative approval."

On July 30, Evers first issued the statewide mask mandate, which went into effect on August 1. The mandate required masks be worn in all indoor spaces or in enclosed outdoor areas. According to the order, violators could face a $200 fine. Evers cited "a new and concerning spike in [coronavirus] infections."

subsequent rules against open burning in a tenderbox forest requires legislative action.

Know who they are, alert hospitals and insurance companies, deny care and coverage. You burn your house down, insurance will not cover. Do not risk health care workers. Their right to life overrides stupidity.

... any more than the earlier lawsuit against Gov. Evers' first safe-distancing order got shot down. WILL, a right-wing "public interest" law firm will push the far right-wing majority on the state Supreme Court to seize more emergency powers from the governor and give that to the legislature -- and of course Wisconsin's heavily gerrymandered legislature is controlled by Republicans, who have demonstrated they don't care about the virus and won't agree to any public-health restraints. The one faint hope is that the court now has one less conservative justice, thanks to the April election in which a liberal candidate defeated a conservative incumbent. But the conservatives still have a one-vote majority. Maybe they'll be a little less crazed now that they see further impacts of the pandemic, but don't count on it. They're raving ideologues, usually.

They've been slapped down in other states, they'll get slapped down in Wisconsin.

They should count themselves lucky. They shot mask scofflaws in San Francisco in the winter of 1918-1919.

Why is this so hard to understand? In Michigan, Gov. Whitmer's AUTHORITY was challenged. The Michigan supreme court UPHELD her authority to issue emergency mandates. Here the issue is Wisconsin state law vs the Governor. The plaintiffs in their lawsuit are asking the court in Wisconsin to rule in favor of the laws of Wisconsin and force the to Governor ABIDE by those laws that says the Governor can only issue emergency orders FOR SIXTY DAYS. After sixty days that the Governor can not extend the order but MUST FIRST SEEK a VOTE and APPROVAL from the State Legislature. Wisconsin supreme court is very conservative so it is likely they will rule in favor of state law.
