Trump Administration Implementing '3rd Country' Rule On Migrants Seeking Asylum

The Trump administration is moving forward with a tough new asylum rule in its campaign to slow the flow of Central American migrants crossing the U.S.-Mexico border. Asylum-seeking immigrants who pass through a third country en route to the U.S. must first apply for refugee status in that country rather than at the U.S. border.
The restriction will likely face court challenges, opening a new front in the battle over U.S. immigration policies.
The interim final rule will take effect immediately after it is published in the Federal Register on Tuesday, according to the departments of Justice and Homeland Security.
The new policy applies specifically to the U.S.-Mexico border, saying that "an alien who enters or attempts to enter the United States across the southern border after failing to apply for protection in a third country outside the alien's country of citizenship, nationality, or last lawful habitual residence through which the alien transited en route to the United States is ineligible for asylum."

(9,401 posts)The Refugee Act of 1980 as well as two different international agreements, are clear and unambiguous with respect to a refugee's ability to present themselves anywhere along the border to seek asylum.
The order is unlawful.

(4,117 posts)laws at all. Any EO can be changed, overruled or reversed by the next President with the stroke of a pen. Agency administrative changes can also be easily undone by the next administration or, right now, be stopped by a simple court order.
See, Trumpyboy can bleat all he wants and make a show of his weird signature on any number of EO's he's done. But no EO can even begin to compete with an actual law passed by Congress and subsequently signed by a president. All that showmanship of his silly EO's is for consumption by his rube followers. Does anyone wonder why he's lost so many cases in court or at the very least has had so many EO's held up by various courts?
It's all because passing successful legislation (re: laws) takes work, the cooperation of House and Senate and the mutual agreement to modifications both House and Senate can agree to. Trump can't legislate a two-car parade let alone pass any significant, nee, any legislation since Day 1. Virtually all of his alleged accomplishments are hollow since they can and will be overturned by a Democratic presidency or as is the current case, get held up by judges.
