WEST PALM BEACH, Fla. A federal appeals court early Sunday rejected a request by the Justice Department to immediately restore President Trumps targeted travel ban, deepening a legal showdown over his authority to tighten the nations borders in the name of protecting Americans from terrorism.
In the legal back and forth over the travel ban, the United States District Court of Appeals for the Ninth Circuit in San Francisco said a reply from the Trump administration was now due on Monday.
The ruling meant that refugees and travelers from seven predominantly Muslim nations Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen who were barred by an executive order signed by the president on Jan. 27 would, for now, continue to be able to enter the country.
After a Federal District Court in Seattle blocked Mr. Trumps order nationwide on Friday, the Justice Department appealed the ruling late Saturday, saying that the president had the constitutional authority to order the ban and that the court ruling second-guesses the presidents national security judgment.

(1,107 posts)The stay was issued by a Washington State Federal District Judge. All Federal District Courts rulings , including stays (injunctions) within Washington if appealed go to the 9th Circuit.
You can't just forum shop to whatever Court of Appeals you like.

A judge in a lower federal court had put a temporary stop to the travel ban. Because the appeals court declined to intervene immediately, affected travelers can enter until at least until Monday. The appeals court set a schedule asking challengers to the ban to file a response by roughly 3 a.m. Eastern on Monday, and the Justice Department representing the Trump administration to reply to that by 6 p.m.
A Justice Department spokesman said government lawyers would wait until then to make their next move.
With the fast briefing schedule the appeals court laid out, we do not plan to ask the Supreme Court for an immediate stay but instead let the appeals process play out, Peter Carr said.
Just hours earlier, the Trump administration had said it was improper for a lower court to engage in second-guessing of President Trumps controversial immigration order and asked the appeals court to dissolve the judges order that stopped its implementation.

This would leave us in chaos and drumpf would waltz right through the hole and reinstate his hate filled ban that has zero to do with terrorism or Saudi Arabia and Egypt would be included.

This is why there really is a difference between the parties and votes for Democrats really do matter.

(23,102 posts)There's split decisions in the federal court system. WA stopped the ban, MA said it could go forward. There will be chaos if Kennedy doesn't vote our way. After fascist is annointed, you are totally correct. Hopefully Kennedy will be appalled by the social decisions and stay, this will really increase his importance and he loves being important.

(23,102 posts)I'm writing letters, calling Congress critters, and boycotting products by Koch or drumpf. Wrote letter to DSW telling them I'd never buy shoes there again until they stop carrying ivanka's shoes. Since my family buys at least a dozen pairs a year there, and if enough other shoe buyers say the same thing, maybe they will stop. I sent a very similar letter to Macy's with others to hit the mail, via snail and email, as well. It's not a lot, but if everyone does what we can, maybe we can make a difference. I also subscribed to The Nation and NYT since they also push back and watch CNN now and no other news, except sometimes Rachel or Lawrence.

If that does happen, I won't be surprised if the congress-critters pass a law saying the Courts cannot legally decide something like this ... then we'll have us an unprecedented (at least in modern history) Constitutional Crisis on our hands ...
A perfect scenario for the GOP to ram through more crappy legislation to favor their rich buddies at the expense of the rest of us.
I sooooo hope Drumpf gets caught on tape telling someone at CIA 'try to make sure some real hombres make it into the US, these courts need to be taught a lesson' or some such.
Of course the Trumpkins will call it 'locker room talk' and excuse the whole thing ... but remotely sane people (and perhaps that might even include the GOPpers in the House and Senate) will realize this absolutely calls for the big 'I' ...
