U.S. judge delays deposition, directs Clinton aide to detail immunity deal in email probe

A federal judge Friday postponed a deposition of a former State Department staffer who helped set up Hillary Clintons private email server, seeking more information about the aides immunity agreement with federal prosecutors and his claim to a Fifth Amendment right against self-incrimination in a civil lawsuit.
Attorneys for technology specialist Bryan Pagliano had also asked U.S. District Judge Emmet G. Sullivan of the District to bar audio- or video-recording of the deposition, originally planned for Monday before lawyers with the conservative legal advocacy group Judicial Watch. The group is seeking to have Pagliano answer questions under oath as part of its lawsuit probing whether Clintons email arrangement as secretary of state thwarted the Freedom of Information Act and release of public records.
Sullivan did not rule on that request to bar recording Paglianos deposition session. Instead, Sullivan directed both sides to address by June 13 the legal authority for Paglianos constitutional claim against self-incrimination.
Counsel for Mr. Pagliano shall file a Memorandum of Law addressing the legal authority upon which Mr. Pagliano relies to assert his Fifth Amendment rights in this civil proceeding, Sullivan ordered in a brief note in the court docket Friday afternoon.

I think several of us here have been wondering if/when the court would inquire about Mr. Pagliano's immunity agreement. I also think we might see some serious discussion about this judge. His past rulings, and style, among other things, are likely to be matters of interest, imo.

(5,400 posts)It might all be on him, and many of us are curious about the particulars of his immunity agreement. Just because he got immunity doesn't absolutely mean he did anything illegal, or even wrong. His lawyer could have just insisted on it as insurance. But it's not a huge leap to speculate that he might have broken the law in a manner that concerns us.
I'd like to get to the bottom of what he did.

What is your point in questioning the propriety of a sitting judge appointed by the spouse of the principal in this case?

(5,400 posts)Please ignore the following if I was just too dense to catch a clever use of sarcasm. Things being the way they are, I hope you'll understand.
I think several of us here have been wondering if/when the court would inquire about Mr. Pagliano's immunity agreement. I also think we might see some serious discussion about this judge. His past rulings, and style, among other things, are likely to be matters of interest, imo.
I think the judge will come off great from that. But I do think that as the public becomes more aware of this case, and the judge's rulings, they'll want to know more about him. Given that the vast majority of people don't follow this FOIA case like we do, they'll have questions, many of which are easy to answer.
They'll ask if he has any obvious bias. An answer could be "He was appointed by Bill Clinton".
Etc.
I hope that explains things and you no longer think I was "questioning the propriety of a sitting judge".

(5,400 posts)I just read a mention of it a few days back. To be honest, I hadn't remembered it as quite that bad.
If you get a chance to watch War Inc, check it out. Imo it sort of exists in a parallel dimension to Grosse Pointe Blank. I see it as what might have happened if Martin Blank's (John Cusack's character) life took a turn for the worse, instead of the better.
Worth it for Joan Cusack alone, lol at her all nervous about having a nice enough room for Anderson Cooper's visit ("I mean, he is a Vanderbilt and everything. There could be repercussions!" .
It's a little rough around the edges, but often brilliant.
