ACA deliberations on the grounds that she was part of the administration that crafted the legislation.
Interesting. I'm wondering if she put pressure on Thomas to recuse HIMSELF on the grounds that he has a conflict of interest via his wife being a lobbyist for the anti-HC reform lobby, and when Thomas refused so did she.
After all, Scalia and Alito have highlighted the point that the Supreme Court justices have absolutely no code of ethics and no rules about conflicts of interest, and their behavior has lowered our expectations to the point where we're almost surprised when they DON'T openly tout their political biases and conflicts of interest.
So, I wonder if there was ever any discussion of reciprocal recusals on the part of Thomas and Kagan? Either they'd both recuse themselves or neither would.
