Ex-intel official: There’s only one person Mike Flynn could give up to get immunity — Donald Trump

http://www.rawstory.com/2017/03/ex-intel-official-theres-only-one-person-mike-flynn-could-give-up-to-get-immunity-donald-trump/

Michael Flynn has offered to testify about possible Trump campaign ties to Russia, but a former top intelligence official said investigators would only offer the disgraced national security adviser a deal if he could deliver evidence against someone higher up the chain.

There’s only one person who fits that description — and that’s President Donald Trump, said Jeremy Bash, the former chief of staff for both the CIA and Department of Defense and former counsel to the House Intelligence Committee.

“For the Justice Department to agree to give somebody like him immunity, it means they want him to turn and testify against someone higher up in the food chain,” Bash told MSNBC. “Who is higher up in the food chain, higher than the national security adviser? There’s really only one person, and so this shows that the jeopardy of criminal liability actually extends all the way to the top.”

Federal investigators have so far have not accepted Flynn’s offer to exchange his testimony for immunity from criminal prosecution, which Bash said raised new questions.

1. I'm not sure about that.

If he could firmly nail Manafort, Page, Bannon, Pence, et. al., I think there may be some 'relief' available to him.

and where there are crimes, incarcerated. Also, it would be nice if Flynn's son gets wrapped into this. As for Flynn, he should be reduced in rank to 2nd Lt., his pension adjusted for his reduced rank, and locked away until he is too old to participate in any politics higher than serving on a condominium board. (That has enough plots, intrigue and counter intrigue to keep him busy 100%.)

2. But what if he doesn't have anything other than "Trump told me to do this." ?

That's not actionable testimony. Which may explain why no one is taking Flynn up on his offer.

testimony he might give before Congress, not for testimony in any kind of criminal proceeding. This means that anything Flynn said to Congress could not be used against him in a subsequent ciminal proceeding.

Second, Flynn could receive an offer of immunity by DoJ prosecutors to give him incentive to give up other members of a conspiracy, like Pence, Manafort, Page, Stone, Kushner, et. al.

was nevertheless prosecuted and did time for obstruction of justice. His prison time was reduced because he cooperated with prosecutors, but the immunity granted him by the Senate did not shield him from criminal prosecution.

expressed myself unclearly, albeit unintentionally. I agree with you! immunity for his congressional testimony only means that testimony could not be introduced as evidence against him in any subsequent criminal prosecution, nor that indictments could issue based on that testimony. Indictments from evidence developed independently would have standing to proceed. Oliver North was tried and convicted, altho an appeals court subsequently threw out the conviction (meaning, ironically, that North was set free on a "technicality&quot .

5. In other words, Flynn's offer signals that Trump is a criminal. Who knew?

...or evidence of his continued relationship with Russia to disrupt American democracy (or both).

I doubt that his attorney would allow Flynn to publically incriminate himself with an immunity request if he had no grounds on which to be granted that request.

Hard to see this as anything other than Flynn publicly admitting Trump is involved.

11. There were several discussions about this on MSNBC Last night

It's all about the angles. One angle, obviously, is Trump himself. Then there's Bannon, Kushner, Sessions, etc. Next level would be the people who are not household names to people who are less than politically aware.

And without knowing exactly how Flynn's acts touch upon the multiple investigations going on, one agency might contest him being granted immunity if it shuts down their ability to pursue him in the context of their investigation.

He is going to have to cough up one very big fish before anyone takes him seriously. I don't see him getting it unless that fish is Trump.

We'll see which of those angles it turns out to be.

Still seems strange for his attorney to make the request if he doesn't have something really good to offer in return.

And a judge agrees to a lesser sentence in exchange for giving up Trump and others.
