Either to a judge or jury. Dropping the charges against the remaining officers simply reflects there wasn't enough evidence to convict.

The prosecution was never able to say who broke his neck, how they broke his neck or why they broke his neck.

The best they could do was say "he broke his neck when he stood up in the back of the van as it was moving." And that's not a criminal offense on behalf of the officers.

Not buckling a seatbelt is not a crime. They tried to get around that by calling it negligence, but the judge clearly didn't buy it.
