Kate Brown’s office on Thursday provide a new look at some of the behind-the-scenes activities ... some provide new insights into the issues under consideration as the nearly six-week occupation that ended Feb. 11 unfolded. ... On Jan. 5, FBI spokeswoman Beth Anne Steele wrote that Harney County Sheriff Dave Ward was “adamant” that he communicate with county citizens. Spokespeople with other law enforcement agencies had helped Ward create a video, she wrote, and the sheriff’s office had established new social media accounts.

“We have found that many local citizens are getting their news from and communicating with each other by Facebook, so the SO is making a concerted effort to own that platform.” .....

Don't get me wrong, I'm glad these fools are getting rounded up and won't be legally allowed to own a gun after this. But there isn't word about hunting in the second amendment, also just in case that you say well they owned musketsmback then. Well that could be argued against first ammendmet rights against the internet and telephone and TV since they weren't around back then either.

Again, I'm in no way for these guys or what they stand for. I myself, don't see any need for anyone to own a .50 either. I know from our conversation that you write and these may be arguments brought against that.

"The Second Amendment of the United States Constitution reads: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

The first part of the sentence is important and until the right wing court decided to ignore it a few years ago the idea that anyone could own any gun they wanted was in question,

Used to take down tanks. That was the original design feature for that. Granted, no army has tanks with such a thin skin. Though with an AP round they can still take up armored civilian vehicles. (No you should not be able to get that round at Wally Guns and Sports). But the original use was not hunting

So we go back to does the Second allow you to own a fully armed and ready to go M-1A1 Abrams? What about an LA Class sub? Maybe a nuclear weapon? If you are not allowed to own those platforms, this is a platform.

So no, given original design features, I don't think I have it wrong. Now if you do, the M1-A1 sucks mileage wise

and there are certain military platforms that are not available to civilians. In fact you can find yourself in hot water for operating current use military gear. And I am betting that a retired LA Class will not be available for civ use, there are laws. It is called the Nuclear Regulatory Agency.

You can buy a fighter jet, 2 or 3 generation... no problem. As long as that bird is fully demiled. AKA no working machine guns for example.

or the cute U Boat that the cartels tried to use to get around the Mexican navy. That thing could not really submerge. Mexico now has a sub... granted, a few generations behind, One wonders if the Navy will use for training purposes though, after they fix it.

Museum boats, with the exception of two, cannot take to see and it they were demiled, they cannot submerge.

there are a lot of practical obstacles that make it nearly impossible but they are not regulated as weapons if they are properly de-miled. That is why you can also own tanks - there are many tanks in private hands.

there is a reason why you can't own torpedoes and missiles. The 2A is limited to individual weapons, not crew fired weapons or ordnance. We drew that line a long time ago.

But I swear to God that I know for a fact that the Paraguayan Army still has a few battle tanks -- not transports or APCs, but actual tanks -- which are vulnerable to .50 cal fire.

They're still running a few of the same tanks my grandfather got shot up in seventy years ago (or were in summer 2014), I was doing research, yadda yadda yadda, the Internet. So, I guess if one is a member of a Paraguayan rebellion, then anti-tank capacity is a perfectly valid reason to own a .50 caliber

You have done a great job keeping us informed on this saga. The charges listed are serious and I suspect will lead to correspondingly serious jail time. However there is nothing regarding damages to the refuge, particularly the artifacts. Have you seen anything relating to that aspect?

.... Burns Paiute tribal leaders were allowed in Monday to survey the damage from the 41-day occupation. The visit was the first time tribal leaders were on site of the armed occupation since the final militants surrendered.

Jarvis Kennedy is a Burns Paiute Tribal Council member. He and the other leaders saw three trenches dug by the occupiers, as well as a newly built road.

“They disposed of their garbage in there,” said Jarvis. “It looked like they used a backhoe to dig a hole and they threw their garbage in.” .....

“Man, what can you do? It’s already done and dug,” said Jarvis, about the trenches. “Now we just have to figure out what’s inside that soil. See if there are any artifacts remaining.”

Historically, the refuge was a vital wintering ground for the tribe. Much of the area is now a protected archaeological site. .........

Oregon law-enforcement officials rule the shooting of Finicum justified—but federal officials are investigating the FBI for not revealing it also fired shots.

Oregon law-enforcement officials ruled the shooting of LaVoy Finicum by Oregon State Police officers was justified, releasing the results of their investigation this morning in a dramatic press conference that featured video and audio of Finicum's death in Eastern Oregon.

But the investigation also found that at least one FBI agent may have lied about firing two shots during the confrontation with Finicum, a 54-year-old Arizona rancher who helped take over the Malheur National Wildlife Refuge.

The United States Department of Justice's Office of Inspector General is investigating the FBI agent for possible misconduct.

The press conference revealed several new pieces of information, including that one or more FBI agents shot two of the eight bullets fired at Finicum and his fellow anti-government militants fleeing along Highway 395 after a traffic stop on Jan. 26.

Deschutes County Sheriff Shane Nelson said in the course of investigating the shooting, his office discovered an FBI agent did not disclose he had fired shots.

New Indictment Alleges Damage To Burns Paiute Site

A new indictment unsealed Wednesday confirms the fears of members of the Burns Paiute Tribe that militants damaged an archaeological site during the occupation of the Malheur National Wildlife Refuge.

The new charge is against occupier Sean Anderson and another defendant whose name has been redacted, suggesting he or she may not be in law enforcement custody.

The indictment accuses Anderson and the unnamed defendant of using “heavy equipment” in a way that damaged “an archaeological site considered sacred to the Burns Paiute Tribe.” It did not go into any more detail. ........

.... the superseding indictment levels five different charges. They include conspiracy to impede officers of the United States, possession of firearms in a federal facility, use and carry of a firearm in relation to a crime of violence, theft of government property and depredation of government property. ........

A study released Monday by researchers at three Utah universities found that transferring national forests and other public lands to the state of Utah would cost taxpayers at least $280 million per year — a price tag that could only be paid if the state were able to increase drilling and mining, seize energy royalty payments that are owed to U.S. taxpayers, and, if energy prices remain low, raise taxes to pay for the shortfall.

The study fulfills a requirement of a 2012 Utah bill mandating the transfer of over 31 million acres of America’s public lands to the state of Utah. The study found that in order to raise the needed funds to manage national forests and other public lands, including taking over responsibility for fighting wildfires, the state would need to pursue “an aggressive approach to managing its mineral lease program,” that would only “be profitable for the state if oil and gas prices remain stable and high.” ..........

During an interview with investigators about the shooting death of Robert “LaVoy” Finicum, an OSP officer said officials were originally considering a location in Grant County for the traffic stop operation, a newly released investigation report shows.

Had the stop occurred in Grant County, then the group would have been closer to Sheriff Glenn Palmer, and the entire interaction would have taken place within Palmer’s jurisdiction.

And that’s exactly why law enforcement opted not to make the traffic stop within Grant County boundaries, said the OSP officer, identified in the documents as “Officer No. 1.” ....

Nevada rancher Cliven Bundy sold close to 1,300 cattle over the past five years and found business in a handful of states even as the federal government sought to purge his herd from public lands, according to state records reviewed by Greenwire.

Bundy sold or transferred cattle to nearly two dozen recipients in Nevada, California, Arizona, Utah and Kansas, according to branding records kept by Nevada's Department of Agriculture.

Nearly half the cattle were trucked about 100 miles northeast from Bundy's Bunkerville ranch to an auction yard in Cedar City, Utah, and 165 cattle were shipped west to a sale yard near Bakersfield, Calif.

Most cattle, about 800, ended up in Utah, according to the records. Wasn't there a lien on those cattle?

George Jessop, of Virgin, Utah, took title to more Bundy cattle -- 153 -- than any other single buyer. All his acquisitions occurred in 2014, the year the Bureau of Land Management tried but failed to impound Bundy's herd. ...............

On a cold January morning, a posse led by a former Army company commander named Matt Shea rolled into the Harney County Courthouse and wanted to speak to the sheriff.

But this wasn’t a group of militants, or outlaws. They were state lawmakers from four western states, including Oregon. Most of them were members of a group called the Coalition of Western States, or COWS.

They were hoping to talk directly with Sheriff David Ward and convince him to support the armed militants at the Malheur National Wildlife Refuge. Instead, COWS members would meet that day with a Harney County deputy and a sheriff from another county, an FBI agent and other local officials.

When Oregon State Police stopped Robert “LaVoy” Finicum along a remote stretch of Highway 395, the militant was desperate to reach one man.

“I’m going over to meet with the sheriff in Grant County,” Finicum yelled to troopers during the Jan. 26 fatal traffic stop, moments before his death. “You can come along with us, and talk with us over there.”

Finicum had reason to try and reach Sheriff Glenn Palmer. Over his four terms in office, Palmer has been outspoken about what he sees as government overreach.

Palmer met with some of the key figures of the occupation over lunch in John Day in January along with a small group of local residents, but said he didn’t know three of the occupiers would be there. ................

An armed militant who was part of the security team during the Malheur National Wildlife Refuge occupation was in custody Thursday in Grant County on weapons charges after threatening to shoot federal law enforcement officers, according to Grant County District Attorney Jim Carpenter.

Scott A. Willingham, 49, was arrested Wednesday in the small town of Mount Vernon on allegations of unlawful use of a weapon, a felony, and second-degree disorderly conduct, a misdemeanor. He was arraigned Thursday in Grant County Circuit Court and held on $35,000 bail.

Carpenter said that during the arraignment, Willingham said he wanted to be jailed in Grant County to await arrest by federal authorities for his role in the occupation. Federal officials wouldn't confirm whether Willingham has been charged, although one name has been redacted from the most recent indictment naming 26 defendants.

A Grant County sheriff's deputy arrested Willingham at a motel after Willingham said that if he wasn't jailed Wednesday, he would "start shooting federal law enforcement officers" the next morning, Carpenter said.

Willingham had a semi-automatic rifle with 230 rounds of .308-caliber ammunition at the time of his arrest, Carpenter said. .....................

Last night I ran into Scott Groene, the Southern Utah Wilderness Alliance (SUWA) executive director, and he asked me how things had changed in Escalante/Boulder in the last 30 years. I told him I could now get a good cup of coffee, but politically things were just about the same. Scott knew that I’ve been active in environmental issues for 35 years in Southern Utah and that in the 1980s I was shot at and endured house vandalism because I filed timber sales on Boulder Mountain and fought the paving of the Burr Trail.

I explained to Scott the ongoing conditions of harassment by telling him the story of a BLM ranger who I met in late October of last year. Jeff Ellison was a first-year BLM ranger in Grand Staircase Escalante National Monument. He had transferred in from National Park Service work at Yosemite National Park. We chatted in my driveway, which is where I met him after he had finished installing a box near a vandalized petroglyph panel within the monument. ....

Federal prosecutors laid out damning evidence this week against several militia members who participated in an armed standoff against authorities at a Nevada ranch in 2014, including seven men from Arizona.

Authorities detailed specific roles each man played in the fight, which pit 200 ranchers and militia members against federal land agents, and asked the court to keep them locked up in Nevada until the trial concluded.

Photographs, videos, direct messages and posts on social media websites were referenced in a series of motions filed in federal court Wednesday to document how militia members answered what prosecutors called a "call to arms” from rancher Cliven Bundy to "forcibly stop federal law-enforcement officers" from impounding his cattle.

Prosecutors claimed militia members were an ongoing threat to law enforcement and said they posed a significant flight risk if released on bail.

Judge Anna Brown ordered U.S. Marshals to take the men to Nevada to be arraigned on charges stemming from the 2014 standoff over Cliven Bundy’s cattle. She also ordered law enforcement return the men to Oregon within 10 days.

“In effect, we would be loaning them back to Nevada for their initial appearance,” Judge Brown said at a hearing in Portland.

The hearing provided a glimpse of how Brown and federal prosecutors in two states intend to move forward with what the judge called “two complicated cases in two districts involving many of the same defendants.”

The Oregon case, with a jury trail already set for September, will likely move forward more quickly, but prosecutors intend to start court proceedings in the Nevada case as well, pursing them on “parallel tracks.”

Oregon occupation supporters investigated for death threats

......... In email, phone messages and Facebook posts, supporters have threatened retaliation for the mass arrests and the death of Robert LaVoy Finicum, 54, a Nevada rancher and a spokesman for the militants, who was shot and killed during the 41-day standoff in Oregon.

The messages target law enforcement officers and government officials, including Oregon’s governor, according to a sampling of threats released last week by the Deschutes County Sheriff's Office. Investigators gathered more than 80 threats as part of the office’s investigation into the Finicum shooting in neighboring Harney County.

“We're going to shoot to kill,” said an anonymous caller to Gov. Kate Brown’s office on Jan. 27, the day after Finicum was shot to death by Oregon State Police troopers in a confrontation on a road near the Malheur National Wildlife Refuge. Another caller to Brown’s office warned, “You killed an unarmed rancher so now one of you must die unfortunately. Goodbye.” ...........
