If the GOP is so adamant about replacing Scalia this year, what will they do if a Dem wins theWhite House? Will they be determined to wait for the next election in hopes of getting a GOPPER?
They probably cannot really delay on the Scalia replacement in the end. But maybe they can. They have obstructed Obama for 8 years on many issues. They have been very consistent on obstruction at every level.

Second, it would raise complicated issues. While Rand Paul is a moron for saying it would be a conflict of interest for Obama to appoint a SCOTUS justice who would then rule on cases challenging and/or defending actions taken by the Obama administration, it would be a much different situation if Obama was put in the position of ruling on his own actions as a SCOTUS justice. The optics of such a conflict would not be good.
Finally, as an associate justice (the least senior associate justice), Obama would be in the position of having John Roberts decide which opinions he gets to write. Can't see Obama wanting that either.
