I thought in some states, if during the commission of a felony, one of the participants is killed, they can charge the Co participants with murder.

I don't know if that's Oregon or not, or if I'm even right.

§ 163.115(3) provides affirmative defenses to murder under the felony murder rule.[3] It is an affirmative defense that the defendant:

Was not the only participant in the underlying crime;
Did not commit or solicit the homicidal act;
Was not armed by a deadly weapon;
Had no reasonable ground to believe that any other participant was armed with a deadly weapon;
Had no reasonable ground to believe that any other participant intended to engage in conduct likely to result in death.


I think prosecutors like to reserve Felony Murder for situations like...oh, three people decide to rob a bank. During the robbery, one of them shoots the security guard. They hang "enhanced murder" on the shooter, and "felony murder" on the other two.

In this case, Felony Murder is kind of a stretch: There were (four?) people in the truck. When the cops ran it off the road, Tarpman jumped out, tried pulling a gun on the cops, and got killed for it. I'd much rather have the nice clean indictment that was handed down, and not something with a bunch of shit they threw on there just to look vindictive.

If they were going to add anything to it, I'd look at charges for tampering with the power company's cameras. That, we can definitely prove.

These people are all sovereign citizens; one of the dicta of that bowel movement is that anyone can file a UCC-1 form (which is a real form, but is used to secure a creditor's interest in a loan in case the debtor defaults) and become exempt from all the parts of the law they don't like, such as the part that says you have to pay your bills.

How well does it work? Not at all, but that hasn't stopped them yet.
