Michigan woman complained after her sentencing that she was only trying to help when she opened fire at a pair of fleeing shoplifting suspects.
Tatiana Duva-Rodriguez pleaded no contest shortly after the October shooting to reckless discharge of a firearm, and she was sentenced Wednesday to 18 months of probation.
Her concealed carry permit was also revoked until 2023.
The 46-year-old Duva-Rodriguez said she opened fire on the getaway car in a Home Depot parking lot in Auburn Hills after she heard a scream and feared the incident was worse than a theft.

Less than a tenth of a gram of a party drug in your pocket? Second Amendment rights revoked for life.
Reckless discharge of an actual firearm? Eight year suspension.

(15,429 posts)Minimal force necessary is the standard. It's foolish to pull a piece over somebody fleeing, let alone actually fire. Even cops aren't allowed to fire on a fleeing suspect without clear and imminent danger from the suspect.

It is merely a fortuitous accident that helped catch the robbers. There is no death penalty for robbery, which is just one reason for not shooting fleeing thieves.
And this was not, under any stretch of the imagination, personal protection.

Oh okay, So you wouldn't have shot at shoplifters had you known that's all they were. Instead you just fired your gun at two people without really knowing what the situation was. That changes everything. Not.

No, we most definitely do not. I prefer that people don't start shooting at people just because they hear a scream and jump to snap conclusions.

Yes, please don't. You're lucky you didn't kill or seriously injure anybody and as far as I'm concerned you got off with a slap on the wrist. As for helping people again, there are many ways to help people without firing your gun at them. Try it sometime.

(34,491 posts)Where some proud gun owner shot at a thief who was attempting to steal an elderly lady's purse. It was caught on video. I believe she injured the perp and he was arrested. Authorities were looking for her but I don't think they ever found her...or at least wanted to find her, so I'm betting charges were never filed. What if the guy had died? It's not like she was wanting to help the authorities or else she would have stayed at the scene to talk to them but no...she hurried up and left the scene. It her mind, a purse snatcher deserves a possible death sentence.

(3,411 posts)Put a whole bunch of laws that stiffly penalize using a gun and not "using the strictest amount of care" when handling or storing a gun, to discourage people from choosing a gun over other kinds of weapons or self defense methods. However, the Supreme Court is the lord of the land so it may still be nullified by the courts.

(3,411 posts)Many people I know who tried to help other people, as well as myself, have been burned badly by them. IMO, its not just me but many people in society, which to me might explain why Americans are relatively cold and unhelpful beyond a casual degree.

(12,618 posts)I think I can safely say that I would not have fired a gun at them if I had one on me (not that I would). But then again, that's precisely why I don't carry one and have no desire to carry one. They tend to make things worse, not better (Just ask Trayvon Martin. Oh wait, you can't. He's dead).
Call me crazy but I'm just not convinced that it's worth shooting somebody over some cheap ass merchandise from a giant mega-corporation.

But my gun isn't there to allow me to play cop. It's not there to let me rush in and "take out the bad guys" or some such bullshit fantasy. There are professionals with more and better equipment to do that. It's there to potentially defend against an immediate deadly threat to me or someone near me. It would come out of the holster if and only if getting the hell out of there wasn't an option (and hiding wasn't a viable alternative).
And beyond the obvious cost to every consumer, I don't really give a shit about shoplifting...

Another variation is the wannabee, someone who is not in any way involved in emergency services at all, but who wants people to think they are. Again, they tend to use their personal car or truck to do this. There is also a paramilitary version, "mall ninjas", who are always wearing camo, collect big Rambo knives (and guns, if they can get away with it), take martial arts courses, read Soldier of Fortune magazine, and fantasize about being a mercenary. Many wannabees and mall ninjas are just misunderstood teenagers going through a teen angst phase, but if this behavior continues into their 20s and 30s it is a good sign they need to get a real life.
Among emergency medical services, "Ricky Rescue" has a similar meaning.

However, when this helpful method fails, apparently the choices are to stop being helpful at all...
... or call for more guns.
The gun makes it so easy to swell with the perception of power until reason is run-over roughshod.
Quick bad judgement bullets bloody the fabric of American. Wounding those who are the guilty, the un-guilty, and the witnesses thereto.
That witness is the spirit, soul, subtle something sense that one means to say "I am an American".
That witness harbors the black-heart of America calling for Muslim bans and beatings.
I'd hate to be growing up six, seven, eight, learning that to be an American now means killing and dying because religion, God and/or Guns!
This American heart however rejects all exclusion, otherness, them-ness, notme-ness, hate, separation, fear, ignorance, hypocrisy, deliberate obtuseness, violence, delusions of illusions of need for gun.
I am sicked that coast to coast, I see so many neighbors to whom I need not talk*, and find so many of them present as clear and present dangers (not necessarily armed) to the 21st century.
*I do not have any regressive friends. I find no evidence that regressives can be reached by reality or reason.

She doesn't deserve a gun permit. I'm a gun owner and I NEVER carry a loaded gun ANYWHERE. I don't "carry" because I'm neither a coward nor do I fancy myself a hero.
Take this asshole's permit AND take her gun(s).
Fuck her. She's one of the reasons some people say the guns in my safe are ruining my country and putting people at risk.
