Lucid isn't the point. He could make it another three years, die, and find a Republican President making an appointment - who'd you rather have then, GOP Justice or Elena Kagan?

the five a-holes (do I need to identify those, too?!1) who are there. I fully realize his age and the gift of retirement. Just to add another aside, the interviewer commented that JPS "is a force of nature who (until recently) played a mean game of tennis" but this does not mean I expect him to work until he dies or to be replaced by a Rethug nominee.

My whole context was my RUEFULNESS that somebody like him appears like a mental giant, especially about the 2nd Amendment, compared to The Five. It was not intended to quibble about who was named after him or that if he were still there they would not be. It was just a *SIGH*.
