This is the best exploration of the events from the phone record and girlfriend testimony, (which, tragically, might be thrown out because of hearsay laws---- I know we have records that she was talking to him, but we cannot prove or assert what she heard from the victim is true, sorry for that, but just a technicality in our laws.)

15. 911 tapes are admissible under several hearsay exceptions in Florida.

Excited utterance, present sense impression (mental/physical conditions) and spontaneous statement exceptions will apply.

Also, since the 911 calls are not testimonial (as defined by Crawford) no Confrontation Clause issues would arise. (See also Davis v Washington)

The testimony of the girl friend is not a recorded testimony, while the 911 tapes are recorded and admissible.

That's all I'm pointing out. HER testimony might not be admissible, the 911 tapes, admissible, for sure.
