TALLAHASSEE -- A DNA analysis completed by the Florida Department of Law Enforcement on Tuesday confirmed that DNA provided by Florida State quarterback Jameis Winston matched the sample taken from the underwear of a woman who has accused him of sexual battery.

Police obtained a sexual assault kit on Dec. 7, 2012, when the accuser reported the alleged incident had occurred at an off-campus apartment. Winston's DNA was recently obtained through a buccal swab he provided to authorities investigating the case.

The DNA match alone does not prove that Winston, a leading Heisman Trophy candidate, sexually assaulted the woman, as the accuser's family claimed in a statement released by a Tampa-based attorney on Wednesday. But it does indicate that Winston, who has yet to talk to Tallahassee police or the state attorney investigating the case, had his DNA associated with the accuser on Dec. 7, 2012, when the accuser claimed she was sexually assaulted.

The Tampa Bay Times releases an explosive report, including a statement from the victim’s family, claiming a Tallahassee detective told the accuser’s attorney that Tallahassee is a “big football town” and her client’s life could “be made miserable” if she pursued a sexual assault case against Winston.


There are accusations of intimidation and threats directed at the victim, (allegedly)coming from authorities.

I say allegedly only because this is an ongoing investigation. But it also appears to be another possible rape by a star athlete that is possibly being covered up by intimidation and threats, coming from local authorities. The victim has claimed that she was threatened by a detective to drop the accusation and be silent or "they would make her life miserable" and that "Tallahassee is a big football town".

Can you believe this shit?

This is why I say it is time to make rape/sexual assault a FEDERAL CIVIL RIGHTS ISSUE. It's time to make it a federal civil rights offense. Too many states sweep these crimes under the rug or under-punish. When a rape/SA is reported it should automatically kick-off a federal investigation or fed oversight of the local police investigation to ensure that said crimes are prosecuted to the fullest extent of the law.

RAPE IS A FEDERAL ISSUE. STATES(usually red states) HAVE PROVEN INCAPABLE OF PROTECTING WOMEN.

It almost seams like red states are pro-rape.

And regarding FSU..

WHERE/WHY no suspension for star QB Jameis Winston while they fully investigate this potentially heinous crime? Rape is a serious felony and one of humankinds worst crimes.

Again, at this point, these are only allegations while this investigation is just starting to heat up.

She claimed her attacker was 6'5".

Winston is 5'11".

She was a sexual assault victim... but it is not at all clear it was Winston.

Unless she recants and says it was consensual, he's going to have to face trial.

I don't think many assault victims are particularly good at estimating height and weight. In addition, most of us have shitty visual memories. That's why forensic evidence is so important.

There was a case on DiscoveryID in which a woman was raped and beaten for several hours. The woman tried to memorize everything about him so that she could identify him if she lived. She survived.

She then identified a man based on her recollections. There was DNA, but this case occurred before there was a sophisticated enough test to create a usable profile. The police could find nothing else that would link him to the crime and he was not charged. She was so upset by his release that she seriously considered shooting him.

When new testing techniques became available, the DNA was tested. The profile generated was entered into CODIS. CODIS is a database that contains the DNA profiles of convicted offenders. There was a hit and it was traced to another man who had lived near her. He was convicted of the crime.

People who study these cases believe that trauma can and does create false memories of some details. The victim does get a lot of things right but not everything.

And yes, I watch way too many crime shows.

She said it was her husband. It wasn't. Years later DNA proved him innocent.

They'll be reminded of Penn St. And FSU, by their own rules, will have to suspend their QB once he is charged with a felony.

I agree: most local yokels don't want to deal with rape crimes. Make it federal.

this is why he is still playing. that whole saga and the way it played out and ended has damaged women to no end when it comes to sexual assault by athletes. if FSU suspends him without even charges filed, they open themselves up to tremendous lawsuits. once charges are brought, the story changes and i believe he will be suspended.

i don't know much about the story except what i have read this morning... but it doesn't look good...

when and IF charges are filed he's done. the question is this : will the DA there in Tallahassee be bold enough to file the charges before the end of the football season? if there is reason to file charges and the charges wait until AFTER football season i think some heads need to roll and investigations should be started...

The victim apparently went immediately to the hospital and had a rape kit performed. The clothers and other items were kept as is procedure.

What this case will probably hinge on is the medical report that is filed with it. In most rape cases, there is damage to the woman that is visible. This can be bruising or tears or both. If that was recorded, he is going to have a hard time.

It is not impossible that he would be found not guilty in a trial. They are crap shoots. There has apparently been so much police malfeasance in this case that a defense lawyer could make it seem as if everything was tainted. If he can change the trial from the DNA and medical report if it shows damage to that issue, who knows?

The question is what does the medical report show?

DOES the report show battery or not. if it DOES, then the DA should be flogged for not bring charges already. if it does NOT, then why is this being bandied about now?

If all of this is true, the person who could bring charges did not get the case. He changed the case to active when he did.

I mean, look how competently they have pursued the war on drugs. Or tax cheats. Or dealt with rape in the military. Our government is not big on enforcing any regulation on anyone who might have the resources to resist, particularly if there is anyone who might be easier to take down.
