Judge Merchan brought the parties into court early on Monday, and said that due to issues that have come up over the weekend closing arguments at the Trump criminal trial wont happen until after Memorial Day. Anna Bower of Lawfare posted from inside the courtroom:
First, Justice Merchan thanks the parties for coming in early. There were issues that came up over the weekend, he says. As a result of some of those issues, its become apparent that we WONT be able to move to summations tomorrow. We will finish up evidence, the pre-charge conference, and so on this week, Justice Merchan continues. And then well move to closing arguments next week, after the long weekend. Now were moving on to issues regarding objections to evidence that might be introduced during the continued cross examination of Michael Cohen. The prosecution objects to the introduction of an email sent to Michael Cohen by Robert Costellos law partner back in 2018.
The new schedule means that the jury might not get the case until sometime in June, and that is without any further issues or delays. June is important because Trump has a debate date with President Biden on June 27. If Trump is convicted, which seems more likely than not, he is not going to have as much time to let the possible guilty verdict blow over and work its way through the news cycle.
The longer this case, the bigger the risk becomes for Trump that he will go straight from the courtroom to the debate stage. It is possible that Trump could have sentencing hearing than have to debate President Biden, or Trump could go from the debate to his sentencing hearing. The longer this trial goes, the higher the probability that it will impact pushed up timeline of the presidential campaign.

The difference here being, its their hearing and its stupid to sleep fart through them. But, they dont seem to get a minor nuance like that.

(4,797 posts)He wants the closing arguments to take place immediately before the case goes to the jury, without a weekend break, especially since next weekend is Memorial Day weekend. I think the estimate of what's left to do before summations has expanded, pushing them back, so he decided to move the closing to next Tuesday altogether.

He will of course appeal. He may or may not be allowed to remain free pending appeal, but if this were any other person, not.

Then the defense puts on their case. Maybe one witness. Maybe tsf.
Then charging instructions get hammered out.

He wants any previous POTUS be "special" and not have to play by the rules.

As court is dark on both Wednesday (Judge Merchan has family court on Weds) and Friday (for Memorial Day weekend), that would mean that there would be 6 days after closing arguments & jury instructions where jury couldn't deliberate.
The judge's decision on this was practical.
My opinion only.

(9,799 posts)what at least one juror will consider "reasonable" doubt. To me, everything we know makes it clear Dolt 45 is guilty as hell of countless crimes & behaves like a mob boss. But that "beyond a reasonable doubt" business is a a high bar (as it should be) & is open to very subjective evaluation.
Plus, if there's just one secret Trumper on the jury, justice is thwarted.
But then, I'm a staunch pessimist!

Better to charge on forward, but there might be some issues with jurors personal schedules over the holiday weekend. 🤷?♂️

The damn documents case is the winner. And he shouldve been charged a year earlier in that one. NONE of these cases are going to do a thing to this dickwad before the election
