According to Meidas Touch, with Ben and Karen (which I can't find right now,) the Prosecutors want to show a key piece of evidence to which the Defense objects. Weisselberg is currently in jail for 4 more months. Defense says he can't be present. Apparently the Judge is in favor of bringing him in just to see if he pleads the 5th, or if he will testify at all. So, it seems like they might be looking at getting him subpoenaed.
Bringing him in from jail is not a problem. Cohen is scheduled for Monday through whenever, followed by at least one other prosecution witness.
Michael Popok discusses this, but not with certain elements supplied by Ben and Karen. I think they have to bring this guy over because the Judge hasn't ruled yet, and there is also something about "missing witnesses" that the Prosecution can fill in. So, it seems to me that the Judge wants to see this guy.

(15,148 posts)He is directly tied up in all of the kaka at the top of the charges, and the prosecutor has documents, witness testimony, and audio tapes directly implicating him.
Plus, he was already convicted on charges where he testified on matters very close to these.
If he strays even a little, he will be risking another perjury charge, and this one would put him away for years since it would trigger a violation of his early release agreement.
He has everything to lose and nothing to gain by testifying. If he tells the truth, he contradicts what he said in his previous trial. If he lies, he contradicts what other testimony already proves.
He is screwed either way, and the prosecution ain't writing him no imunity deal.

I believe that means if you still want to keep covering for someone else, it's either contempt of court for refusing to testify, or you commit perjury and hope not to get caught at it.
