The Posse Comitatus Act forbids using federal troops to enforce civilian law unless there is an insurrection.

And isn't a denial of an elected seat may be a type of insurrection as well?

Either way paratroopers are more intimidating.

Not sure if they still have bayonets but that would be fun to watch.

local paper had a front page picture of a trooper with a bayonet angled upward and outwards and he was facing some bigot holding his bleeding face after being hit with the butt of the soldier's gun. I'll bet he had some stitches later! Those trooper looked quite intimidating in pictures.

[link:https://apnews.com/article/360439e805eb4db180fbfd52a7a0f5bb|]

It was in these operations that the two men were injured. C.E. Blake, 46, a railroad employee, tried to grab a paratrooper’s rifle, soldiers said. The trooper, quickly reversing it, struck Blake over the eye with the butt. He fell to the street but did not appear to be seriously injured.

Paul Downs, Springfield, Ark., got a bayonet cut in the arm apparently when he was too slow in obeying an order.

This was not the picture I was referring to but check out the kid turning his face and looking at the bayonet.

I'll never forget that picture. We could never understand the hate.

In Selma, if I remember correctly, after the first march across he Edmund Pettus bridge was met by police with dogs along with hatemongers, Kennedy federalized the Alabama National Guard to escort the second march. Wallace was allowed to spew his hate but then he and his minions backed off.

integrating Little Rock schools. That's not the same as using active duty troops on US soil. That would be illegal under federal law, i.e., the Posse Comitatus Act of 1878. Like Rome, we don't do that. Or at least we don't. Sulla and then Caesar broke the Roman rule.

Not that I don't appreciate what they did, but that seems a violation of federal law. Some loophole perhaps? But then again, who was going to argue with Ike in 1957. Imagine the screaming on the right if Biden did that.

56. No. The Posse Commitatus Act of 1878
Mon Jul 24, 2023, 08:37 PM
Jul 2023

was a reaction to Reconstruction after the Southern whites regained seats in Congress.

In 1957, Eisenhower acted under the authority of the Enforcement Acts of 1870 and 1871, criminal statutes designed to protect African Americans’ right to vote, to hold office, to serve on juries, and receive equal protection of laws. Because the Enforcement Acts are criminal in nature, and because they predate the Posse Commitatus Act, it is unclear they provided a legal basis for the use of federal troops in the Little Rock desegregation crises of 1957. It seems clear to me that Arkansas Governor Faubus was engaged in an act of sedition in using the Arkansas National Guard to thwart the orders of the federal courts and would have justified President Eisenhower invoking the Sedition Act.

My conclusion is that President Eisenhower did the right thing but with the wrong legal justification.

I remember raising this issue in a discussion at the Army JAG School during a presentation about the Posse Commitatus Act. The instructor was not prepared to discuss whether President Eisenhower had violated the Act in 1957, and brushed-off my question. By that point, I was sufficiently labeled as a trouble maker and easily dismissed.

White people like this believe that only other white people have the right to win elections or to make the rules for how black people and other minorities are to behave as subservient to white people. It’s why so many Republicans hated Obama—he was obviously smarter then many white people, he occupied the Oval Office in a position they believed was reserved for white men, he was handsome, and he has a beautiful wife and daughters to boot.

Sounds like the Kim regime in North Korea or something. "Hand picked succesor"? WTH?

Newbern had not held an election "for decades." Instead, "the office of mayor was 'inherited' by a hand-picked successor," and that mayor then chose town council members, again without an election. All prior mayors have been White residents, the lawsuit said, even though about 85% of Newbern's population is Black. Only one Black person has ever served on the town council.

As for people who were elected to their jobs (like the clerk of court, maybe), the locks on their offices should have been changed, new keys available at the Mayor's office, just come on by and pick them up from the Mayor, security issue dontcha know.

There are ways to deal with an entrenched good ole boy minority.
