Supreme Court to hear 'Trump too small' trademark case; man wants to trademark phrase mocking Trump

The Supreme Court said Monday it will hear a case in which a man tried to trademark a phrase mocking former President Donald Trump as “too small.”

The Justice Department is supporting President Joe Biden’s once and possibly future rival in urging the court to deny a trademark for the suggestive phrase “Trump too small” that a California man wants to put on T-shirts.

Like those brain on drug commercials with eggs frying. Have "this is your brain" with a drawing of a brain. Then "this is your brain on Trump" with a tiny brain under a magnifying glass.

It’s the Biden Administration that brought the case to the Supreme Court

“ In its appeal to the Supreme Court, the Biden administration argues that the living-person rule applies equally across the board. Besides, Solicitor General Elizabeth Prelogar, argues, allowing Elster to trademark “Trump too small” wouldn’t promote political speech, but instead restrain it, since a trademark owner can sue to stop others from using a registered term.”
