Jim Jordan Doesn't Have a Leg Stand on In His Beef With Alvin Bragg
The New York DA's authority to prosecute Trump is damn-near absolute.

I remember when everybody thought New York DA Alvin Bragg was wet-noodling on the subject of the former president*. I'm even old enough to remember when every Republican that mattered was a "Tenther," an adherent to the primary constitutional heresy, thought to have been crushed out at Appomattox, that the 10th Amendment pretty much obviated any attempt to enforce the 14th amendment out in the states. But the former president* has proven nothing more than he's proven that he can turn everything on its head.

The ongoing slanging match between Bragg and Rep. Jim Jordan, the jacketless hunter of snipes from Ohio, is a perfect miniature of this state of affairs. Jordan says Bragg is overstepping his mandate in pursuing El Caudillo del Mar-a-Lago and he's doing it by pole-vaulting over the sacred Tenth. Bragg wasted no words in pointing this out to Jordan in a letter responding to Jordan's request to ransack Bragg's office in pursuit of snipes.

Your letter dated March 20, 2023 (the "Letter&quot , in contrast, is an unprecedent inquiry into a pending local prosecution. The Letter only came after Donald Trump created a false expectation that he would be arrested the next day and his lawyers reportedly urged you to intervene. Neither fact is a legitimate basis for congressional inquiry... it is clear that Congress cannot have any legitimate legislative task relating to the oversight of local prosecutors enforcing state law. To preserve the Constitution's federalist principles, the District Attorney is duty bound by his constitutional oath to New York's sovereign interest in the exercise of police powers reserved to the States under the Tenth Amendment.


This is legalspeak for "Piss off, Junior."

We trust that you appreciate the importance of our federal system, state law enforcement activities, and the critical need to maintain the integrity and independence of state criminal law enforcement from federal interference. While the DA's Office will not allow a Congressional investigation to impede the exercise of New York's sovereign police power, this Office will always treat a fellow government entity with due respect. Therefore, again, we request a meet and confer to understand whether the Committee has any legitimate legislative purpose in the requested materials that could be accommodated without impeding those sovereign interests.
