He is going to say that he was a member of the Legislative Branch and therefore cannot be subpoenaed by the Executive Branch because of the "speech and debate" clause? He is going to claim that as President of the Senate, he was in the same position as a Senator or a Congressman? The Vice-President has nothing to do with the Executive Branch?
Good luck with that, Senator Pence.

(16,949 posts)Former VP Mike Pence is barking up the wrong tree. He has no Constitutional legs to stand on. His presence in the Senate is 1) To break a tie if needed. 2) Ceremonially preside over the counting of Electoral votes on Jan.6th after a Presidential election.
As Tribe also explained, Pence's case will not go far in the Courts.

(3,441 posts)He doesn't want to be seen as ratting on Trump. If he does, he will have no chance becoming president. He has little chance anyways because he refused to take part in the fake elector scheme. Trumps behavior was disgusting, and he knows it. He won't confront Trump or the Republican Party on it for the sake of his own ambition. Then he acts like his character is unapproachable. If you look up sanctimonious in the dictionary, Pence's picture is right next to it.
