(95,075 posts)Too many States have a sore loser law that prohibits a candidate from getting on the ballot as an Independent or third party after losing a Primary.

I've made OPs about this very thing. I'm convinced if trump isn't on the ballot 100s and 100s of thousands of trumpers are gonna write him in. This will mean Biden will cruise to a victory.

In August 2015, Winger compiled a list of precedents supporting this interpretation. He argued that in 43 of the 45 states with sore loser laws on the books, the laws do not seem to apply to presidential candidates. Winger claimed that sore loser laws apply to presidential candidates in only two states: South Dakota and Texas.

Didn't win for T. Roosevelt or any of the lesser knowns that tried it since. Orangeanus has to be aware of the doom that befell every one who tried.

(999 posts)Each party controls their primary process and it wouldn't surprise me if Trump demands that the party anoint him as the defacto candidate. Trump wants all the campaign cash he can grab and the Republicans do not want Trump to humiliate any of thier future Presidential candidates.
A third party run by Trump would create two Republican losers in one election and I don't think party hierarchy will allow that. I truly believe that the party faithful are hoping for a Trump indictment followed by a drawn out trial that ends in a conviction.

(7,291 posts)Much as I'd prefer never to hear that obnoxious drawl or see an image of that revolting bloated physog again, witnessing a record victory for the Democrats up and down the board would be worth the teeth-gritting.
There might be some mopping up to do as his more deranged supporters set about each other and anybody that got in the way, and the overspill had unfortunate consequences, but sometimes a festering boil's better lanced, sterilized and done for good.

2) Even if Trump lost a primary, he'd need to support the nominee to get the promise of a pardon and/or disabling any DoJ probes/investigations.
So... not a chance of a 3rd Party run.

(32,181 posts)GOP insiders would know that most states have "sore loser" laws which stop a candidate who loses a primary from being on the ballot in the general election.
in other states the time limits to get on the ballot for an independent/third party run in the general election would have run by the time a primary is held. So its impossible to get on the ballot.

(11,694 posts)If he declares without going through the Republican nomination process the laws do not apply. Plus, write-in votes WILL HAPPEN if he goes rogue regardless of the process. These votes will be wonderfully wasted...

Which means he would be going through the Republican nomination process. Sore loser laws would apply. Trump would not engage in an embarrassing fruitless write in campaign.
