At issue in National Pork Producers Council v. Ross to be argued on Tuesday is a 2018 proposition approved by California voters which prohibits the sale of pork in the state if it was produced using inhumane breeding methods.
Proponents of the law say its simply meant to set standards for the production of pork products sold within the state, while opponents say its a road map for both red and blue states to try to export their moral judgments across state lines.
The case would trigger harmful interstate trade wars as other states attempt to mimic Californias regulatory strategy, said Jonathan D. Urick, associate chief counsel for the US Chamber Litigation Center. The group filed an amicus brief in support of the pork producers.
Proposition 12 prohibited the sale of pork in California if pigs are raised in breeding pens that dont allow sows to turn a full circle. Hardly any commercially bred sows are housed in compliance with Prop. 12, the National Pork Producers Council says in its brief.

(19,285 posts)Pigs are incredibly intelligent animals with unique personalities. They know nothing but pain, fear, and misery from the moment of their births to the instant they are slaughtered. In a metal pen you can't even turn around in? People go to jail for treating their dogs this way. Pigs are just as deserving of humane treatment as dogs are.

(32,161 posts)The main issue which brought this case to the SC (which the OP does not mention in the summary) is that CA wants its inspectors to be able to go to any other state and make inspections in that state. That would encroach on the rights of other states by CA.
CA can ban pork in CA if that is what they want to do.

(22,237 posts)It always broke my heart to drive past farms in Calif and see the calves in itty bitty cages so they couldn't move whatsoever. Right out front in some places.
Its what makes the meat, "tender."
At least they finally banned foie gras in CA, although they can still buy it from out of state.
