In a new filing flagged by Politico's Kyle Cheney, Cannon amended her previous order to state that the seized material subject to a special master review no longer includes the "approximately one-hundred documents bearing classification markings."

The 11th Circuit, a three-judge panel that consists of two Trump appointees, criticized arguments made by the former president's lawyers, who wanted the DOJ to be forced to stop its probe into Trump's decision to allegedly keep top secret government documents stashed at his Mar-a-Lago resort.

In their ruling, the judges noted that Trump "has not even attempted to show that he has a need to know the information contained in the classified documents. Nor has he established that the current administration has waived that requirement for these documents."

The 11th Circuit granted a stay pending appeal but DOJ has not yet filed the full appeal. I would guess they are trying to determine if letting what’s left of Judge Cannon’s order represents a precedent they cannot live with.

19. For the most part the judiciary has held the line. Cannon is not worthy of a lifetime appointment to

the bench. Unlike Dearie who has actually handled national security cases, Cannon is a light weight making decisions from the bench more from a political point of view than a federal judge upholding the law. Her decisions were amateurish, lack any basis in law or fact, and disregarded her oath to her position. When you think of the federal judiciary people with courage come to mind, not some light weight attorney whose resume falls far short of that which is required to a lifetime appointment to the bench. Cannon should be held accountable because any way you look at it she was exposed as an incompetent judge who doesn’t have the intelligence or experience to be handling cases involving national security.

Nor will they be, now. The classified items are no longer within the special master's purview. The stuff that will be furnished to the SM and the lawyers is all the rest -- the non-classified items.

As to the "whistleblower," I'm assuming you mean the person(s) who directed the FBI to look in certain places for the missing documents at Mar-A-Lago. I'm not aware of any formal requests by Trump's attorneys for the identity of the person(s) involved, let alone any success in gaining access to the info.
