Based on our dismal history of trying and failing to hold the wealthy and powerful accountable in this country, this is just another swing and a miss. If we had a functioning justice system, Trump would already be indicted in multiple jurisdictions on multiple charges. I could be totally wrong about that and I can't say I have that much faith at all in the DOJ. Yes Trump appointed a lot of judges. But then again, those same judges ruled against him 60 times in the "Big lie" suits. Then the Supreme court ruled against him a mere 8 months ago. There is hope, we'll just have to see if the DOJ had the fortitude to do it.

The OTHER thing is that the DOJ can outright arrest Trump at this point and by doing so, Mirandize him and interrogate him if he waives Miranda.

The DOJ doesn't have to wait for the appeals ruling on the documents when they have enough to charge him with RIGHT NOW. The DOJ can always add new charges after the 11th or DC Circuits and SCOTUS rule.

The DOJ has four more days to decide to charge, or they have to wait until after Nov 8.
