NEWS: A judge appeared poised to restrict DOJ's access to materials seized from Trump's Mar-a-Lago estate while a special master reviews it, @joshgerstein reports from Florida.
Judge Cannon said she might carve out an exception to allow ODNI review to continue.

Judge Cannon didn't issue a ruling, but she raised concerns about the review and didn't seem deterred from her initial view that she was "inclined" to appont a special master.
CANNON also seemed inclined to allow the special master review to consider executive privilege, over DOJ objections that no possible claim of executive privilege against the Executive Branch could ever succeed.

WEST PALM BEACH, Fla. A federal judge indicated Thursday that shes seriously considering temporarily barring Justice Department investigators from reviewing material seized from Donald Trumps Mar-a-Lago estate.
U.S. District Court Judge Aileen Cannon suggested that shes considering issuing that limitation, while potentially allowing an exception for the intelligence community to continue reviewing national security risks from the potential exposure of the seized documents.
Justice Department attorneys pushed back sharply against that outcome, warning against any disruption to their ongoing criminal investigation of Trumps handling of classified documents. Cannon, who previously said shes inclined to appoint an outside review of the materials seized form Trumps estate, appeared undeterred during a two-hour hearing that featured arguments from DOJ counterintelligence officials and Trumps legal team.
Justice Department attorneys repeatedly pleaded with Cannon not to interrupt their ongoing criminal probe, emphasizing that the search warrant executed on Aug. 8 was clearly valid and authorized to obtain evidence of three significant federal crimes.

Cannon at one point indicated prosecutors may be overreading Nixon v. GSA in so stridently saying that Trump cannot assert executive privilege.
At another turn, she stopped Jay Bratt when he said the seized materials were classified. He had to note they were marked that way.

(115,705 posts)so I don't know what difference appointing special master would make at this point. The investigation will continue regardless. And the DOJ did insist on a tight schedule if it were to happen. I have to think this is all just a sideshow.
