Texas Hospital Staff Says Vaccine Mandate Breaks Nuremberg Code

A Houston hospital will become the first in the U.S. to fire workers for refusing Covid-19 vaccinations starting on June 7, unless a state judge intervenes.

About 117 staffers sued Houston Methodist Hospital Friday in Texas state court, claiming the facility’s vax-or-pink-slip mandate violates World War II-era ethics codes designed to prevent medical experimentation on unwilling human subjects. The so-called Nuremberg Code was developed in response to Nazi atrocities conducted on concentration camp victims.

About 99% of the 26,000 employees of the hospital, a cornerstone of the famed Texas Medical Center, are already in compliance with its vaccination mandate, according to an email sent by Marc Boom, the hospital’s chief executive officer, to all employees and physicians. The remaining staffers were reminded they have until June 7 to get the jab or face the consequences.

The lawsuit represents an escalation by Jennifer Bridges, an outspoken Houston nurse, who took her complaints to social media shortly after her employer’s vaccination policy was announced. Her April 17 Facebook post attracted 94 comments and encouragement to hire a lawyer. Her name is listed first among the plaintiffs in Friday’s complaint filed in Montgomery County, about an hour north of downtown Houston.

Ensure any mandatory vaccination policy addresses requests for accommodations under the Americans with Disabilities Act;

Ensure that any mandatory vaccination policy addresses requests for religious accommodations under Title VII of the Civil Rights Act;

Determine whether an accommodation is necessary for any employee who refuses to get the vaccine, such as a work from home arrangement or a temporary leave of absence;

Educate employees to the greatest extent possible before issuing a mandatory vaccination policy to minimize confusion and refusal once a policy is issued;

Ensure compliance with state laws that may be implicated by a mandatory vaccination policy.

People receiving the COVID-19 vaccines at this point are not taking part in a medical experiment, because the vaccines already have gone through clinical trials and have received emergency approval. And so the Nuremberg Code does not apply.

Full Fact, a British non-profit fact-checking service, does not think it’s a coincidence that anti-vaccination propaganda is focusing on ethics principles that came about in response to Nazi atrocities -- because the very subject of the 1933-45 Nazi regime in Germany gets people worked up. “Misinformation thrives when feelings are manipulated in this way, as claims which create an emotional response are most likely to be shared,” the fact-checker states.

“Drawing a link between this final rollout of these [COVID-19] vaccines and what the Nazi doctors were doing is morally grotesque,” Dr. Julian Sheather, a special adviser in ethics and human rights for the British Medical Association, told Full Fact.
