Assault and Battery Charges in South Carolina

Generally, assault means causing someone to fear that the actor will cause physical harm to the victim. Battery, on the other hand, is when the victim actually suffers physical harm. Thus, an assault can technically exist without a battery, but the SC statutes link them together under the charge titled “Assault and Battery.”

There are 3 degrees of Assault and Battery in SC. The more serious the injuries, the more jail time and/or fines a person can face. In addition to first, second and third degree Assault and Battery, there is a charge for Assault and Battery of a High and Aggravated Nature (ABHAN).

With all the degrees of assault and battery, keep in mind that the “degree” is not the same thing as the number of “offense.” For example, sometimes people call me and say, “I was charged with Assault and Battery third degree. This can’t be right because I’ve never been charged with Assault and Battery not even once before, much less twice before.”

I quickly explain that Assault and Battery third degree is not the same as Assault and Battery third offense. You can be charged with Assault and Battery third degree even if you have never been charged with Assault and Battery before, and even if it’s your first alleged offense in your life.

More than likely the local police will raise the charges to battery since he did put his hands on him. Probably a fine and maybe a little jail time

After that the Army will then have their say. Probably loss of rank and pay. Will be on his record for the rest of his army career which will effect his future promotions. Loss of pay might effect his house payment so I expect them to be moving.

Interesting to see what the HOA is going to do. What can they do?

And here's the thing, that was the racist's wife who filmed and published this. They were proud of his actions.

There's this false idea racists have that they think they are representing the majority, that they'll be cheered for something like this. They don't have the fore sight to understand that even other racists are going to be appalled at this, they will have no defenders.

This guy might get kicked out of the army for this.

Cassie’s Taunts

One of the most disgusting aspects of the video is that the wife seems to know the deadly role that the police will play, and embraces that role. She knows that Deandre is obviously uncomfortable, but believes that the threat of the police will truly get him to leave. Pentland’s wife is apparently named Cassie:

At the beginning of the video, Deandre seems to understand the ridiculousness of the situation. He visibly shrugs and states calmly, “Call the police.”

Cassie chimes in loudly:

It’s almost as if she is frustrated that Deandre ISN’T scared of the police, and is adamant about the fact that he SHOULD feel scared. At around 5 seconds into the clip, she screams: “They’re just waiting!”

Just waiting for what? Like many other racist white women, Cassie seems to believe that the police will inevitably side with her. She speaks of them as if they were created to deal with arresting black men for walking all the time.

It seems as if she truly believes Deandre will be arrested, given her following statement:

If you read further in the Twitter thread, someone states that the cops said they could only get Pentland for property damage (knocked Deandre's phone out of his hand and onto the ground). There is literal video evidence of Pentland pushing this young man.

Now, what would have happened if that young man had pushed Pentland in the same manner? We all knew the answer.

This douche is in the military. Our tax dollars pay for his housing, healthcare, and salary. Fucker better get discharged.

I think the Army will look hard at Chapter 12 of the admin discharge regulations. This is the Misconduct chapter, and it effectively ruins your life. Since the cops have nailed him for property damage, a civil conviction will follow and that gives them the grounds to use this chapter.

Alternately, they’ll pull in his troops and start trying to put together a “pattern of minor misconduct” that will justify using the chapter.

My recommendation to this asshole: hit the commissary today and drain your checking account buying canned goods. You’re gonna need them.

being in the middle of a fire fight and your platoon sergeant telling you that he doesn't want your kind with him.

I would equate a Drill Instructor as being on the same level as a platoon sergeant and they would be held to a higher standard of conduct.

Again, when it comes to filling out that employment application and the question comes up, "Why did you leave the service after 14 years?" I'd luv to be a fly on the wall.
