Democratic state Rep. Park Cannon is setting up a great defense to the arrest and charges. I notices that in the various videos you can hear Rep. Park Cannon stating that she is a member of the legislature. There is a good reason for this.

She is seen yelling in one video: "There is no reason for me to be arrested. I am a legislator!".....
Georgia's Constitution says lawmakers "shall be free from arrest during sessions of the General Assembly" except for treason, felony or breach of the peace.
Cannon was charged and brought to a local jail. By 11 p.m. she had been released, according to her attorney Gerald A. Griggs, who spoke to a group of reporters and supporters outside the jail.
Griggs told the crowd that Cannon sustained bruising from her arrest. He was joined outside the jail by Sen. Raphael Warnock of Georgia, who visited Cannon in jail. He told the group that he is also Cannon's pastor.
Rep. Park Cannon is being careful to preserve this defense if this case goes to trial

(17,763 posts)I assume she could legally have been removed from the building without being arrested, but does "pounding" on a door (knocking?) or "screaming" (talking while black?) actually rise to the legal definition of breaching the peace?
gratuitous
(82,849 posts)I saw footage from the room where Kemp was signing this toxic piece of legislative sludge, and while he was yakking about what a great day it was for Georgians (or some similar crapulousness), he was interrupted by Rep. Cannon's knocking, turned toward the door, and said "What's that?" So, breach of the peace.

(7,820 posts)So how is this a defense? But how is what she did not protected free speech? Plus, it now looks like a knock on the door is a more serious crime than insurrection. How is that for standing justice on its head? Or should I say Republican justice.

(165,906 posts)There will be a motion to dismissed filed in this case based on this provision in the Georgia Constitution

(16,427 posts)Knocking on a door would not be considered a felony when such wording was developed. Felonies were crimes like murder, rape, burglary, kidnapping and arson.
It is a perversion of the criminal system that minor crimes have become felonies.

"She's facing up to eight years in prison," Cannon's attorney, Gerald Griggs, told CNN's Don Lemon on "CNN Tonight."
"We're planning on having conversations with the district attorney, hopefully to convince her to dismiss the charges. But if not, we are going to take this case all the way to jury trial and convince the jury that she did not violate any code section of the Georgia code and that she should not have been arrested."
Referencing circulated video footage of the incident, Griggs added, "We are continuing to get the rest of the videos and we're going to fight this case all the way to jury trial."

(78 posts)... this defense serves to muddle
the fact that there was no cause for arrest -- period
whether the person arrested for Knocking While Black
was Black, White, Woman, Man, Legislator,
Dog Catcher, DEM, GOP, Homeless, etc
it's simple false arrest.
Looking forward to the Civil Suit and Settlement.
