I don't know the law, but it seems to me to be totally bonkers to think any court would halt certification because a plaintiff claimed they'd be following up with actual evidence real soon now.

(4,787 posts)Apparently, their latest fundraising messages indicate that the share of donations going Trump related PACs is now 75%! You can't fund raise for challenges if you're not doing them.
It should also be noted that SCOTUS has had a suit related to PA's late-arriving mail ballots in their in-box for nearly two weeks and has done ugatz with it. (These are the several hundred ballots that were set aside and not included in the tallies.) They've yet to even put it on the schedule for their weekly discussion conference.
Not to mention, the federal appellate courts as well as SCOTUS do not generally hear cases that are presenting evidence for the first time. You know, the evidence that Trump was holding back at the circuit court level, where it's supposed to be presented!

Sure, there are cases where discovery is necessary, but you need to provide evidence to support the notion that there is some "there, there" that you are looking for. They aren't doing anything like that. Just claiming they "know" there was massive fraud, and just haven't actually gathered the evidence of it yet. The only thing close to a request for discovery is asking to count the ballots themselves, with absolutely no justification for what they would "learn" that is not already known or discoverable based on the normal processes.

Biden has a monumental job ahead.
