No, a charge of rape must be answered in one’s individual capacity (unless rape is in one’s job description, and he was NOT RAPING on behalf of the American people in his official capacity as President).

Bill Barr needs disbarment in the worst way.

As I recall, because raping female prisoners wasn't in the guard's job description, the county couldn't possibly be liable for his misconduct while on the job. I don't think defaming private citizens is part of the president's job description, is it? So the United States of America can't be substituted for Donald J. Trump as the defendant, right Judge Amy?

According to Amy Coney Barrett. Ergo, denying rape cannot be done in an official capacity. Also, Article Two makes no mention of denying rape. What would Scalia say?

I'm pretty sure that the defendant at issue wasn't "The President of the United States" and rather, it was the pedestrian American citizen and resident of New York City, Donald J. Trump. And I'm also pretty sure that means that when Trump responded, it wasn't in the capacity of the Leader of the Free World, that is, The President of the United States.
